Hi all,
Because of urgent family issues I had to come back to India and had to stay here. However during the panic mode I applied for my re-entry permit (e-file and send the docs to my brother in USA who mailed it from there) since I had been in India for longer than 6 months and will not be able to go back to USA till another few months or so.
Do we have any instances where ren-entry permit was approved even if it was applied from overseas? What are my chances?
Finally on a similar note, my wife's ren-entry permit got approved (she applied it when in USA and then travelled back to India) however because of address change issue her permit got lost in mail. Now BCIS is asking us to re-file the application. If we file it again then her case will be similar to mine where the permit will applied from overseas.
What are our options? Should we return back to USA now for a week or so and apply re-entry permit again? or should I wait for approval/rejection action on my previous application?
Would it be better to speak to a lawyer to handle my case?
