Applied for GC-New Born in India

Hi,

I've applied for Green Card. It is in the process. I'm now in H1B and my wife in H4 visas. We r planning to have our new born baby in India.

Will there be any complication in the GC process if my baby is born in India?

Will there be lotz of paper work for the baby after I come to the USA to apply for my baby's GC?

Can anyone help me in this matter?

i have no clue as not a lot of ppl on h1 go to india for kid...trust me,u r not assured of a gc jez coz u applied for one.

Assuming that your kid is born before you and your spouse become permanent residents, you can apply for his/her H-4 visa. After you return to the US, you can use your approved I-140 petition to apply for your kid's green card.
 
There is no complication. The only downside is that you have to pay more fees later on (I-485 stage, processing fee, medical examination, etc.). Also, there is no guarantee of a smooth sailing on your GC process. If your child is born in the US, he/she automaticcaly becomes US citizen, no waiting period etc. to become a citizen.
Our daughter was born in the US. Fortunately for us, our GC process is also completed in slightly less than 4 months. If your are applying under EB1, then the waiting time for your GC is not significant. Otherwise, the waiting period (until tyour pririty date become current) to file I-485 is going to very long -- several years. This is just to get the green card. After that there is a minimum 5 years wait to get citizenship. Think about this.
