Hello,

My I130 petition was approved. It was supposed to be AOS since the beneficiary is physically present in the US. However, on 18th June, I received notification from NVC. What should I do in this case? Should I request NVC about changing it to AOS? Since F2A category is current, I am preparing to submit my i485 package on August. Any help is greatly appreciated.

Thanks!!

Just go ahead and file the AOS in August. NVC will automatically be notified that AOS has been filed.

Thanks for you response. I will definitely file 485 in August. I was reading some other blog posts. It says that the NVC might send the I130 package for consulate action and could take some time to get all the documents back to the USCIS for AOS. I am trying to see if I can contact NVC and let them inform just to avoid any delay. Any thought on that?

Until you pay all the fees and submit all the documentation that NVC ask for they won't send the package to the consulate for interviewing.

As Jackolantern stated file a AOS in August. In the AOS package include a copy of the I-130 approval notice.

Thanks all, you guys are really helpful. I will go ahead and send my package with a copy of I-130 approval notice.
