Application returned by NVC to INS

Hi,


My I-140 was approved in Sept 2002. I chose to go the CP way and my attorney sent my application to the NVC. The NVC generated a case number and I was waiting to hear from the Mumbai consulate for my interview. But , when I checked with the NVC last month , I was told that my file has been sent to the INS.They could not tell me the reason except that INS asked for my file to be sent back to them .When I checked with the INS , they could not tell me the reason why my file was returned by the NVC. My case now seems to be in a limbo as no one has a definite answer on where my case stands. Has anyone here experienced this before ? Please post your experiences and advice.

I am not speaking out of self experience.

If the case is re-called by INS for any reason, then you would
have to contact them through your Attorney. Normally they
would not entertain queries from the candidates.

Ask your attorney to call them and find out the reason.

I can only understand what you are going thru as I went thru the same ordeal last year.

My file was sent to INS by NVC after I mailed my P3 to NVC for no reason. For two months -- INS kept denying that they have recd. the file and NVC kept saying that they have sent the file to INS. Operators at NVC were unable to give me the reason why file was sent back to INS, they just said reason is probably in the file.

But with the help of my HR, I continued calling INS regularly and also had my lawyer send them letters every 3 weeks - till INS acknowledged file is with them after 3 months and won't mention why they asked it back or when they will send it back to NVC.

I finally wrote to my local senator and seeked his offices help. Finall his ofice did respond and file was sent to NVC after 4 1/2 months.

Everycase is different - hence your case could be different than mine - but continue calling INS & sending letters to them till you get them send file back to NVC. I wish you all the best.


Also - just a thought - do you have any other processing going on at INS i.e another I-140 etc.. which might need cross checking with you other files - I remeber INS mentioning this can be one of the reason my file was requested back eventhough it was not true in my case.

I am in exactly the same situation that you are in. My
lawyer just mailed in Packet 3 to the national visa center.
When I called in to check to status of my case at NVC
through the automated voice machine I am told that
my case was returned to BCIS ( INS ). Kindly advice what
I should do now. How did you handle this situation.

Anybody... advice...
