I am appealing my asylum case being denied and being granted voluntary depature

appeal filed March 5

My brief was due and subbmitted on or by Aug 24
gov brief was due on Sep 14
not submitted

does this mean anything at all , good bad any ideas

DHS trial attorneys do get lazy. The BIA will adjudicate based on what they have.

I have noticed that you are really well versed in immigration matters, are you an attorney? Come to think of it, a lot of immigration attorneys are not as knowlegeable.

Depends. In close calls not filing a brief makes the Gov. look bad in the eyes of the BIA judges.

Another thing I have noticed over the years is that the DHS does not file briefs if they feel that the cases are overwhelmingly in their favor (they think their cases are such slam dunks that they have better use of their time).

So it really depends on the strength of your appeal.

I am a law student. I have done a significant amount of pro-bono asylum work under a special BIA rule allowing law students to represent asylum seekers (under the supervision of licensed attorneys). I also speak (on behalf of refugee organizations) from time to time with CIS management about asylum issues (one thing that we advocates do is to try to have a good working relationship with CIS people; this can make a difference for our clients in marginal cases).
