What documents are required to travel outside the country on AP. I dont have any Visa but pending Adjustment of Status. My Visa period completed 6 years.
What documents i need to carry while travelling to India?
What documents i need to show while going to india?
What documents i need to show while coming from India?

Any suggestions please!
Thanks.

If your Advance Parole is still valid, then this is the only document you will need to reenter the US. It won't hurt to carry an employment verification letter from your employer.

Travel on AP

Hi Friends,

We would like to visit mother country next month for a period of 2 months.

We completed our fingerprints in April 05 (code 3) which included biometrics.

In this type of scenario they can issue green card at any time, I guess.

Once GC is Approved (issued) can we renter USA with AP?

Based on my understanding once GC is issues my H1/H4 and AP/EAD no more
valid.

Thanks
Lustra

No -- your AP can still be used for re-entry even after 485 approval.
(you SHOULD NOT, however, use your H visas for reentry)

You'll be given a "defered inspection" at the POE -- you need to go to a local office and complete the process (by getting a 551 stamp)

Hi Max2k1,

Thaks for your reply. But nowadays with code 3 (With out 551 stamping)without infopass some people are getting Plastic card. In this type of scenario they can issue green card at any time.

Once GC is issued can we renter USA with AP.

YES - as long as you left the country with your 485 pending or just around approval.

Max2k1,
I also did FP the other day and I 485 could be approved any time. I have planned to travel oversea in July. What if several hours before I aboard the airplane my I485 got approved? What document should I use to get into US?

Thanks very much!

docs required for travel on AP

My wife will be using her AP to reenter. Does she need to keep all the 3 copies of AP with her? Can she show just 1 copy of the AP?

She is currently working on her EAD. I suppose she should carry -
- employment letter
- EAD
- 485 reciept notice

Any other documents???

Thanks

All you need to carry is:
1. Passport
2. AP (all copies, though they will most likely only look at and stamp one)

In these days of big identity theft problems, I really would limit what you carry to what is actually needed.

Ginnu, HMD, RealCanadian and others please respond..

ATL10Again.

I am now in the same situation as ATL10Again, I had to travel for an emergency in India on 1st of June. I had my FingerPrints too done on Apr 13th. What if my I-485 gets approved right before I leave ? I do have my AP with which I am planning to exit and return to US.

If you read AP authorization guidelines for your self, it states that the AOS
will resume after your return from foreign travel. Doesn't it means that there is not chance of I-485 approval/denial before your return from foreign travel?

You should carry your AP and passport for sure.

It doesn't matter if your 485 gets approved just before you leave -- I think about 15-20 days before your departure is OK (since it "officially" takes about 30 days for you to get the approval notice -- AND since you don't have to sign up for email notifications).

Its a good thing if it gets approved :)

Technically, AOS is supposed to "freeze" when you are out of the country.

In reality, I don't think USCIS ever tracks anything at that level of detail -- your 485 processing proceeds normally (if you can call these 2+ year backlogs normal that is !!)

So, its always better to keep a valid AP and not depend on the fact that AOS won't get approved when you are abroad.

what line at POE

just got AP approved for a dependent from TSC and got two copies. from what i have gathered from the forum, i should carry both copies upon my return to the US along with the passport.

the question I have is does a person returning on AP go to the 'USC/GC' line at the POE or the 'non-immigrant/visitor' line?

thanks.

* Carry all copies that you got (plus keep a few photocopies to give to some pesky airlines)
* You are not (yet) a USC/GC holder .... so you just go to the "visitors" queue.
