AP Travel Dates

Hi,
I and my wife has applied for I-485 and Texas service center in June 2003 and have got EAD's We both have valid H1-B Visas mine is valid till Nov 2005 but my wife's H1 is expiring this month.

So we are planning to file for Advance Parole but I have some concerns about it .

1. Do you really need to fill the Intended date of departure and expected length of the trip while filing for Advance Parole. ?

2. What would happen if I put a tentative date and then dont travel during that period, would the AP become invalid ?

My lawyer advised me not to file for for AP until we have definte travel plans since the date is needed otherwise it wont be approved and I also see that the delay at TSC for AP is around 8-9 months.

------ just write any date departure Fab 11 length of trip 5 weeks, you can write any date

-------- they don’t care about the date, if you don’t travel on that date nothing happens AP will be valid till expiry date

----- Lawyer is wrong, fill up any date, they are only interested in the BCIS fees and relevant documents just write the reason on cover letter to meet old parents or vacations everything is fine. you dont need lawyer do it yourself
