Gurus,

If a person is working on H1 and has a valid EAD, but the EAD is not used. Can you travel on AP without using the EAD? Does anybody have this kind of experience. Please answer.

AP can be used in either case..
does not matter you are in H1 or in EAD..

but if you have valid H1 visa to reenter and if you havent
"USED" EAD then you can just use H1 instead of AP..

bcoz you have to get new AP for every reentry...
and valid for just 1 yr.. better save it for another unexpected
visit...

Thanks for responding. I have one more question.

Let\'s say you don\'t have H-1 visa stamped on your passport. You only have valid H1. Can you enter US with H1 and I-485 receipt or you still have to go to consulate to get H1 visa stamped on your passport to enter in US?

I am also in the same boat, I have the valid H1 visa, but my visa stamped in the passport got expired, also I have valid AP but not used EAD. In case of emergency if we want to go out of USA and come back, can we use AP or we need to get visa stamping in the home country(India)?
