AP Question

Hello,

I am stuck in NC process for last 14 months. I had my family based AOS interview done in April 2006. My H1-B visa expires in April 2007 and have not stepped out of US since my arrival in US since 1998.

My questions is if I apply for AP, can I travel outside US? What is the risk for doing so. What is the risk of being denied at port of entry.

I don't intend to travel but want to have AP for family emergencies.

As long as you haven't been out of status for more than 180 days, which it doesn't sound like you have, there shouldn't be a problem.

Thank you,

I have not been out of status. But during the interview last year, the Immigration Officer had told us not to travel out of US, when we had asked her if I could visit my homecountry as my father was having double bypass surgery? Thankfully he is doing much better.

Does anybody have experience with AP and port of entry?

I used two APs (six months duration each) during my AOS. I made 9 successful re-entires into the US without any issues. This was Nov 2002-Oct 2003.
