We waited nearly 174 days to apply for I-485 for my wife after her K-1 expired do to fact she was pregnant you think we can recieve AP
 
hi - it shouldn't matter how many days it took you to *file* the I-485 after her K-1 expired. The only thing that is important is that you were married within the 90 day timeframe after she entered the country.

As long as you can prove that you married in the timeframe set forward by the K-1 - by sending them a marriage certificate along with the other evidence required for the application - then you're fine. Go ahead and apply for the I-131. You're definitely eligible. (I'd suggest you send them a real, certified marriage certificate rather than just a copy, because we recently got an RFE for an I-765 EAD application we'd filed asking for a real, certified marriage certificate instead of just the copy).

My wife is worried to travel because she is from colombia and thinks that they may not let her back in because of the rep Colombia has , but we really appreciate the advice she is sitting here next to me and just saw this , god bless you , any more info would be good how does it work we are sending the
copy of I-94 expired, the photo portion of passport copy, the visa portion of passport copy, two photos,original marriage certificate, letter of intent, copy of I-485, we live near Miami and the travel warning scared us, we have a baby born here in USA and i read that they can not denie re=entry if it defers family union

On the bottom of our receipt for I-485 has MO missouri adress what
part does missouri play in all this? and how long does it take to transfer case to DO? Miami is workimg still on I-485 from Jan 2004 we are desperate for AP
how long can or should she go to Colombia for to visit family we want to introduce our child to his family down there! Thanks in advance for any help you can bestill upon us Blessings ERIC and Lisney
