AP Question

I am planning on using AC-21, I already have an offer and have accepted it.
I have never applied for AP, I talked to the lawyer of the company which I am going to join in a week. He seemed to be a bit baffled when I explained him that I have an H1b and I am using it to go back and forth the country.

Is it that I cannot apply AP now at this juncture ?

Any advice would be appreciated.

Concurrent - 140/485 - RD - nov 2002.
140 approval date march 2004.
EAD 1
EAD 2 - valid till july-2005
FP1
FP2 - August 2004.
 
You can

AP has nothing to do with AC21. You can apply for AP or EAD as long as you have a valid 485 pending. Once you change jobs you'll need to travel with AP as you are no longer maintaining H1 status unless you are transferring your H1 to the new employer.
