AP pending and travel plan

Hi All,

I am planning to go to my country INDIA for 4 months. and my AP is pending..Can I leave the country while AP is pending. and If my AP gets approved before my vacation. Can I use it to enter into US?

AP Pending & Travel

Do not leave the country if your AP has not been received. You will need it to get back in. Even if you have an H1 b still current, you may considere to have abandoned status of your 485 if you leave while it's pending. This is a very gray area and my attorney has advised me the same thing. It will all depend on who the Immig. officer is on the day and they could or could not bar you from re-entering.

It's not wort the risk in my opinion.

I agree. My lawyer has advised not to leave the country while the process is still pending.
