AP in Buffalo office?

I filed concurrently my I-140 (NIW), I-485, EAD and AP at the Vermont service center.

RD - Nov 26 2002; ND - Dec 20 2002. EAD status - "ordered a new card on 02/12/03". No card yet.

The application for the AP is still pending. My lawyer called in the Vermont center and was told that they are mailing a RFE for my I-140 and before that no EAD/AP will be issued.

That's confusing. As my EAD has been already approved, so something's wrong. Has anyone had similar issues?

I need to get my AP ASAP, because I've got a family emergency. What should I do? I belong to the Buffalo office area, but on its web site it says that they issue APs only to those whose I-485s are being processed at the Buffalo office. These policies different in each and every field office. So, has anyone had any experience at the Buffalo office with getting AP?

If it is a provable emergency then you should go and try at the buffalo office.
Maybe you can take the EAD and show the local INS office so that RFE is answered and AP is approved...

The thing is that my EAD was approved before the RFE for the I-140 petition was issued. My AP hasn't been approved yet.

Is it common that AP/EAD are not issued before the underlying I-140 is approved when one is filing concurrently?

Also, if my parent is in the hospital and I must go help him, what would be a good piece of evidence for the INS to issue AP? A letter from a doctor on a hospital letterhead would suffice?
