Guys,

I have H1B valid till next year. However I applied for AP and EAD. Travelled outside US and Reentered USA with advance parole.

1. Should I have to renew EAD when it expires even though I have valid H1B?
2. Heard from some of my friends that becos I reentered using AP , I am no longer on H1b status and only on EAD. Is this correct ?
3. Should I have to renew my AP even though I don’t have plans to travel outside the country in near future?
4. Because the stamp is valid for one year, What should be done to get new I94 card when it expires?

Please reply.

Thanks

1. If you have valid H1 and haven't used EAD, and dont plan to change jobs and if you are sure you can hold on to the current job till your GC, u don't have to renew your EAD.
2. << I am too eagerly waiting for an answer to this question >>
<<to my knowledge re-entry using AP shouldn't VOID H1>>
3. If you don't have plans to travel in the near future, you don't have to renew AP. Incase of emergency, you can go to local office to get one[only for emergency cases]
4. Nothing to be done w/ expired 94 card when it happens..!!

But generally people, irrespective of they use EAD/AP, due to the economy, and other stuffs, do renew EAD/AP..!!

Hope this helps

1. It is always safer to keep renewing EAD
2. If the H1 was valid , you can go back to H1.
3. yes renew AP. AP approvals do not come overnight. Emergency APs are a rarity and a hassle.
4. With I485 pending your status is now covered. If you plan to use H1, I suggest that you do the H1 revalidation at St. Louis.
