AOS - when to file

My wife is taking her naturalization oath next week. I'm currently under F1 visa and have just enrolled in another semester at college.

How soon can I file for AOS? I'd like to file as soon as possible.

You could file at any point after she becomes a US Citizen. In reality you could file the same day. However, don't forget to have her make several copies of the naturalization certificate and to include a copy with her I-130.

You can file the day she naturalises. Just make sure it has been more than 90 days since you last entered the US on your F-1 visa.

Just stay in school and file, don't drop out because USCIS might want to eat you for breakfast during the AOS interview

Thanks for the advice!

Do you recommend hiring a lawyer for this process or does it not make much difference? How much would one charge?

Mr. Art Vandelay,

Since you are into shipping business, then you can ignore hiring a lawyer because it is NOT necessary to spend your lunch box money on such a luxury. Most college students I know or see are poor, so you need to save every dime you have for your wife and schooling resources. If I were in your position, I wouldn't hire one unless I plan to commit a crime which might require a lawyer. How long have been on an F1?

Correction, I'm an importer-exporter :)
I'm going on 4 years now under F1, I have a clean file with the college and USCIS.

Anything from the lower 1K's to 4k depending on how much work you do and how much they do :-). If you have a straightforward case, just do it yourself. There is a ton of information on this and other forums.

1.5k would've been as far as I would've invested in this. I have a fairly straightforward case, I just wanted to make sure the AOS goes through smoothly because each semester at college is costing over $6k and I'd rather take a year off till I'm considered a resident, then continue studies.
