AOS under 245(i) INTERVIEW

My wife is a USC. She has filed for me relying on 245(i) and we have already paid the penalty fee. I am eligilbe because my step father petitioned for me back in 1996 but the petition was just marked abandoned. At the time I was about 14 years old and the main beneficiary was my mom. I am now relying on this for AOS. I now have an interview scheduled on 12/1/09. Has anyone had a similar situation. What questions were asked at the interview. I am not worried about questions pertaining to my marriage to my USC wife because the marriage is bona fide. However, I need to know what they will want to know about the old petition from 1998. I have very little recollection of it if none at all! Thank you!

I was wondering if you could tell me how was your interview? What kind of questions did they ask you, I'm in similar situation as you. My interview is scheaduled on january 2010 I really could use your help.

I was under this as well. Make sure you bring documents showing where you were at the time of or before 2001. Make sure you also have proof of the person who petitioned for you before 2001.
 
They did ask me where I was at the time of or before 2001. I had my highschool transcripts to show them plus they had a copy of it in thier file.

It really depends on the officer. I would rather have all the documents ready instead of them telling you to bring it back.

I really dont understand why you had to file 245i because if you are filing under marriage to a USC you dont need it, so I think you just made your case unnecessarily complicated and wasted $1000 on the penalty fee...

Did you use a lawyer?

If memory serves correctly, 245i forgave Entry Without Inspection, which an Immediate Relative petition doesn't do.

Whoever gave you that information is wrong.

You DO need to pay 1000 penalty fee for ANYONE filing under the 245i.

I think the point was that for a lot of Immediate Relative cases, 245i (and the penalty) is not needed since adjusting as an Immediate Relative forgives most (but not all) of the reasons why you'd use 245i in the first place.

True... but the OP did not mention that he entered without inspection so I assumed that was not the case.

I am aware of that, what I was saying is that you do not need 245i if you are filing under marriage to a USC... except of course if you entered without inspection.
