AOS through USC marriage Pittsburgh District Office / VSC

Hi All,

I am going to file my application for AOS through USC marriage this week (beginning of October 2004). I am currently on a F1 Visa.

If someone have experience with applying to Pittsburgh field office and Vermont Service Center, I would be grateful if you could answer my questions below:

1/ I am particularly anxious about being able to travel abroad in January 2005. Can anybody share the timelines.

2/ I noticed that both VSC and Pittsburgh process travel document applications (see https://egov.immigration.gov/cris/jsps/ptimes.jsp). Can I ask to have my I-131 processed at VSC, where the processing time (3 weeks) is shorter than in Pittsburgh (4 months)?

3/ Is it a good idea to go to Pittsburgh field office in person and ask for advance parole documents?

4/ What are the requirements for obtaining an emergency advance parole?

First of all you will drop your application in your local office and they will redirect to National Benefit Center/ Missouri Service Center (NBC/MSC) both are same. This office is processing solely for married based cases.

Yes you can get emergency Advance Parole from your local office after applying your original Ap to MSC. But you have to show some proof like medical report or other proof which makes the officer comfortable and the officer will give you the Ap for 3months within an hour. But you have to pay again.

Hi I live in Pittsburhg and

also sent the whole kit to Pitts local office. But it was directed to Lee's Summit (Missouri SC) - NBC. Here are my details:

Docts sent on 06/01/04 (sent them through regular mail to the local office in Pitts)
ND I-485 /I-130 : 06/17/04
FP for I-485 : 07/20/04
ND I-765: 07/22/04
FP for I-765 : 08/28/04

EAD .... waiting

dip92 is right. All your docs will be transfered to Missouri SC which currently process family based immigtration. And also about the fact that if you want a fast AP locally issued by the local office in Pitts, they will want strong background reasons. Otherwise it will probably take a while and you'll have to postpone travel. Or who knows you might get luck if you send them ASAP. Still dont attemp to send to VSC, because it will be transfered to NBC again and you will lose time
But you dont have anything to do with VSC. You case with no doubt will be transfered for processing to MCS (NBC), like all similar cases statewide.

Would you please keep up with the thread. Because we also live in Pittsburgh. We might share info or talk.

Thank you very much for your message and your notification that Pittsburgh office does not process I-130/I-485 applications but instead transfers them to NBC/MSC.

I was also wondering:

1/ If I leave the country in January 2005 and have my AP mailed to me by my wife who would stay in Pittsburgh (assuming that AP will be issued sometime in January or February), will I be able to reenter the country?

I know it does not look like a safe thing to do.

2/ Is the processing at NBC/MSC faster during the fall because less nbc employees take holiday time in the fall? Any prediction of the future workload will be appreciated.

3/Mike & Rali: did you also apply for AP?

You would run the risk

That's what I think. It will be risky to travel without it and to wait for it in your country. I am not sure but your exit will be recorded, and actually you'll be travelling without official permit by INS (which is the AP). In this case you'll violate your pending AOS status and might be rejected.

I didnt apply for AP at all, cause we have too many urgent plans to go through with my husband. But when we decide to takea trip I'll apply for AP at least 6 months prior to the trip.

AS far as I see followng the threads in the forum at NBC some people are lucky- get EAD /AP within 2 months and others have been waiting for 6 months already.


But Camembert - Dont leave the USA without AP. You'll violate your status and provoke assuming of rejection. My visa sponsor (of my previos J1 status) told me "Now when you went from J1 to family based AOS, dont travel unless you have AP. You are not allowed to cross even the Canadian border without AP. Otherwise - ..... "
Dont man. Hold on and if you can find strong proof of the reasons for urgent travel. Send everything to Pitts (or mai, in person, whatever is convinient for you). Within 2 weeks you'll get the Notice form MCS and with it and strong reasosn go to Pittsburgh (you know Sidney St) and ask for AP. You might be lucky and get one the same day. Depends on your reasons.

I dont know men. But you'll take a great risk not to be able to re-enter USA, once leaving it without the official permission by INS (AP)
 
I just hope you didn't buy any plane tickets or anything like that

file that paperwork right away

but hold off on those plans just in case it doesn't come on time.
