AOS Rejected - marriage to USC application

Hi everyone,

I just received a rejection notice for my 1-485 application packet. I had filed this along with the I-130 petition from my wife, a U.S. citizen. The rejection stated:

Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

The following documents may be provided:

Your original Form I-130 (Petition for Alien Relative) if you are filing concurrently, or
__________________________________________________ ____________________

I don't know what to do now. The I-130 application was also returned, without a reason but with the I-797C. I have the following questions:

On Part 2 of Form I-485,
I chose (a). But I did not attach a copy of the I-130 application because the I-130 application with the required documents had been concurrently filed and mailed in the same packet.

Should I have attached a copy of the I-130 here with the I-485 application, as well as the separate cover letter/I-130/photos/ sent in the same packet?

Should I have selected (h) and explicitly written out that a form I-130 had been filed by my US Citizen wife along with this application packet?

I'm thinking of maybe filing the I-130 first, then filing the AOS later on.

you need to choose h) An I-130 petition is being filed concurently
And have all the forms together in the same package with a cover letter showing the supporting document for each form.
 
Marking A was correct and I think your application was rejected in error. Just send it back with a cover letter.

1) Original I-130 application

2) Copy attached with I-485?

I had everything in one large envelope, one file folder for I-130, one for the rest.

This must be some kind of mistake. Unfortunately, the USCIS sometimes makes mistakes like that. I remember a story from a couple of years back, when somebody got their application back because the USCIS misplaced a page or two from one of the forms. At least they didn't cash your checks. ;)

I sent my application exactly like you did (without a cover letter) and everything worked out OK. I included only one copy (the original, that is) of I-130.

I think I would just file again, with a detailed cover letter clearly stating that this is a concurrent I-130/I-485 application (in bold letters), and listing all the included documents. If it makes you feel better, I guess you could include an additional copy of I-130, but clearly state it's a copy, or you'll confuse them even more... ;)
