AOS processing questions?

Hi, im a winner of DV2005, Im a F-1 graduate student and been living in the U.S for 6yrs and always legal and always a student with 1 year of OPT( optional practical training given from the INS) with no criminal record.
my dv number is AS5** I recently realized that my number is extremely low and I have already sent the DSP I-230 and I-122 to KCC and stated that i want the INS to process my file(i hope i did the right thing).now im confused even more since KCC told me that they are not handling my case no more and they will turn in my paperwork to INS. here are few questions that I would like to ask if anyone kind enough to guide me through this.
1.does INS set interviews based on dv case numbers(low case number first than high case numbers) or first-come-first-serve basis?
2.how can I set an interview with the INS?
3.Is it possible that the visa will runout before my interview date even begins and my low case number does not guaranty me to be in time for my INTERVIEW since many people overseas with higher numbers are getting their visas before I did since consular interview date is faster (I heard consular is faster).
4.will i get a notice/receipt once i pay the $100.00 INS processing fee?what will the notice say?
5.Do i have to keep bugging the INS by going to the INS office asking for interview date or the interview date will be send to me by mail once i pay the $100.00 INS processing fee?
6.where can i gain more information on this matter on INS website? any specific phone number to contact the INS regarding DV2005 winners?
7.I realized that I still have time to email KCC to have my paperwork processed through local embassy in my home country (yes, I can email KCC and ask them to have my application processed by them not by INS. I spoke to one of the representative on the phone from KCC about this).your honest opinion on whether I should go through AOS** or CP***.

Hey there,
I'm glad that there is someone who has a similar case to mine. I am also a winner of the DV-2005 and I am also in the US and I am also a F-1 visa holder. The only difference is that I am married to a permanent resident and therefore cannot go to my home country for an interview. Anyway, the local INS keeps on giving me different information, and not only them, my lawyer does as well as the people from Kentucky.
What I did so far is that I sent the two forms that you are mentionning together with two pictures that they asked for. As far as I understood, now I have to wait for their resposnse and for the instructions about paying $100. Than I should wait end of september ans than start calling Kentucky to see whether my case is current. Once it is current, I should go to the local INS and get a number. That is the part that I am afraid of since those guys obviously do not know enough about this lottery or they just didn't have enough experience within the US.
I know that I didn't help a lot, but at least I'm happy that someone else is also having a hard time.

yes, you are right about everything you have said above except that I do think we can pay the $100.00 ahead of time even before the visa number is available/case number is within the range. the only risk of losing $100.00 is that when the case number is never available (i.e your above the cut off number). about calling the the KCC about the case number availabilty everymonth, you can check the case number/visa availability by looking at uscis visa bulletin ( http://www.travel.state.gov/visa/frvi_bulletin.html). it basically states the ammount of visa available every month. currently the USCIS still processing the DV2004 until the end of september.

do you know what do we need to bring to USCIS office once the case number is available? anyone here have any ideas? I had spoken to KCC personel by phone, she told me that we only needed to bring the $100.00 receipt and the congratulations letter after that the USCIS officer will set up an interview date and give us an idea on what other documents to bring for the interview in the future.

btw do you have low or high case number? mine is very low so i might get early interview and im soo worried since I have to prepare my documents ahead of time than everyone elses and the USCIS office is really-really far from where i live (on another state) :(.

any additional information is appriciated.

I guess I will answer my questions myself and if im mistaken please correct me. this informations are intended to help shed some light on some DVwinners that are confused about the AOS (adjustment of status issue).
answer:
1.dv case numbers and NOT first-come-first-serve by looking at http://www.travel.state.gov/visa/frvi_bulletin.html
2.bring the receipt of the payment and congratulations letter to your local USCIS office and ask for interview and additional documents to bring for the scheduled interview in the future.
3.low case number will have higher chance of getting an interview but all based on visa availability everymonth. your case WILL NOT be processed until your case number is within the range of visa availability published everymonth on http://www.travel.state.gov/visa/frvi_bulletin.html .
4.not sure about this but I have spoken to KCC personel, she said they will send me a receipt of the payment.
5.no need to keep bugging them, when a person case number is up then he/she case is available for processing until then just keep an eye on the buletin. interview can be set when the case number is up and the person needs to go to local USCIS office to set one up.
6.none available except the bulletin as far as i know.
7.Im going through AOS way :D.

any comments or critics on this matter is greatly appriciated and the information above is based on my knowledge through reading and asking the USCIS and KCC personel. I will not take any blame/legal action for any misinterpertations and accuracy of the information above.

Anyway, I don't know if it will help, but here are the forms that my lawyer told me that I'll have to fill out since I' m applying from the US.
I-485, G-325, I-765, I-181. (just to let you know that I couldn't find one of those).
By the way, my number in EU16***. Not that great, ha?
One more question: you think that I should pay those $100 even if I still haven't received anything form KCC? Guess it cannot harm the whole thing.

about the $100.00 I sent mine 3 days ago since my case number is low and i did talk to KCC officer, she said the $100.00 fee is non-refundable so If your visa number over the cuttoff limit than you lose $100.00(the case not going to be processed in time). for your case, u still have few months to send the check since your in 16*** range.

Affidavit of Support

Hi,

I'm wondering if "Affidavit of Support" is necessary for DV program winners when applying through AOS.
I-485 instructions itself don't say anything about DV winners, so it is unclear for me.
Second question about filing instructions: if you don't have a middle name,
what do you need to put in the relevant place of the form ?

i was wondering...does the above statement mean tht the Kcc will not refund the 100 dollars and send a reciept if the Dv lottery number is higher than the cutoff number???

Hi, I am happy I found you. I am a J1 living in Indiana, my husband won the lottery with EU00014***. After a long research I decided against AOS for consular processing. I was hesitant whether to get involved in this thread because I am not 100% sure about stuff I want to tell you, just quite sure. But well, information cannot hurt, so just use your judgement. So after my husband got the letter saying he was selected I spent a lot of time on the internet, talking to my schools international office and chatting with former DV winners. I found that several DV winners were not able to get their GC because the BCIS was slow processing their case. This applies especially to people with higher case numbers. I was told that yes, you have to bug the BCIS, because they are not always aware that you may not receive your GC beyond September 30 under any circumstances. I also talked to the BCIS myself and it amazed me how much they did not want to help me and how little they knew about the lottery. Therefore, I decided for consular processing, because I understand better what the steps of consular processing are and what I need to do to maximize my chances. This will be a strong statement so take it accordingly, again using your own judgement: If I were you I would redirect my papers to consular processing. I chatted with people who did exactly that and got their GC with no problem. Also, there are some people on this very forum, who send desperate messages, because they may run out of time because of their slow AOS.
