AOS Pending, Laid Off and Still Unemployed?

Is it necessary to have a job for the I-485 to be approved? My case was submitted in Dec 2001. Recently got laid off. The attorney from my company tells me that I will be Ok even if I were to receive an RFE since I had the intention of continuing at thisparticular employee until my lay-off.

Anybody in the similar situation.

Thanks!

It is not necessary if you are lucky. My friend wasn't employed when his GC is approved. He got no RFE/interview.

However, if you do get RFE/interview, you must have a similar job.

Good luck!

AC21 explicitly says that as long as your salary prevent you from being public charge, then you should be fine. There is no mention of LC salary. However, your case will be stronger if you make more than LC. Under the current market situation though, you probably should just go with whatever you can get. Having a job is always better than having no job.
