AOS or CP???? HELP!

May I have a question for all of gurus.
I am current in I-140 processing. My attorney told me that no matter I want to go for AOS or CP, I have to make decision after I-140 apprived.
One of my friend told me today that I must declare to go CP while apply I-140, otherwise it will be AOS.
Can anyone tell me which one is correct???? Thanks.

you should mention to opt for CP in I-140 application by choosing chennai consulate. If you didn\'t choose that and choose US instead, by default it means that you opted for AOS. If your I-140 is not approved yet, you can send an ammendment request for CP, and if you are lucky they will consider it other wise you have to apply for 824 to convert your app from AOS to CP.
