AOS interview before EAD and Biometrics

Hi all,

I am in Santa Ana, CA and applied for family based I-475, I765 in October 2005.

Until now (6 months) I didd't receive letter of appointment for fingerprint.

But I received letter for AOS interview and went for interview on March 10, 2006. The interview lasted for 30 min and I was approved.

But the interviewer said: " I am sorry because I cannot issue any paper for your legal stay in the US, you have to wait for FBI check".

I asked her about my problem, that is I didd't receive any letter about fingerprint and EAD. I also told her about my communication with National Customer Service before the interview in which they said that I should go for the interview and at the interview I would be told what to do.

The interviewer said sorry and showed me 5 other cases that have similar problem as mine. She said that the system had something wrong and in the same day she met 6 interview cases without fingerprint. She said I should be patient to wait but she was not sure how long it would take.

IS THERE ANYONE WHO HAS THE SAME SITUATION AS ME?

First, I had doudts and thought my case has something wrong because it did not go smoothly in chronological order. But yesterday I received my Employment Authorization Card, I was so happy but after that I was terrified because the picture and signature on the card are not mine, although other information is correct. I now trust in what my interviewer said. Now I try to call them to ask about my status and change my AED card.

IS THERE ANYONE WHO HAS THE SAME SITUATION AS ME?
 
I say now you should get an INFOPASS to see what they tell you. I'm not yet in that stage of the process but I've read many posts about similar situations. I know in some cases in an INFOpass they will take the fingerprints and pictures right there. BUT that's not in every DO.
Try calling the 800# but I think dealing with this in person will be better
 
My DO is also Santa Ana, I was scheduled for FP approx. 3 months after RD. I think you really should get InfoPass 'coz your case is kinda weird, and also you need to ask them what to do with your incorrect EAD card.
 
you didn t say if an officer gave you appointment letter for fingerprint and biometrics. If not, he should have done that. I had similar situation, at interview I was missing biometrics and I got an appointnt for it on the spot
 
That case is similar with mine.

I went to interview in Newark, NJ on 01/31/06, before fingerprint taken. Before interview went on, the officer asked me if I could go to get fingerprint tomorow (which was on 02/01/06). I answered yes, then after He said approved the application, He gave me an appoinment letter for fingerprint, and I am still waiting for the result untill now.

As every one else has suggested, make an InfoPass appointment with your DO, right away. If you had been reading posts in this forum before you went for your interview, you would have known to ask the officer to schedule a FP appt, when she told you about the other similar cases with no FP till interview. Do you have a FP appt already? If not, then get in touch with the officer who interviewed you, (even before your InfoPass appt) over the phone and ask her to schedule it for you. This is what the officer was supposed to have done, anyway at the time of interview.

Regarding your EAD, you can hope that the issue will be fixed at the InfoPass.

Recently, I've come across so many cases of Interview being scheduled before FP, just in Newark. I wonder where the problem is - NBC or a glitch in the system that just affects cases randomly, especially so many in Newark?

My mother's case - I already see is following this trend. We did not get the FP notice more than 2 months from RD - I'm quite certain now that the IL is going to precede the FP notice. I was at Newark DO recently to get expedited AP for her and I was asking a supervisor there what if .... the exact same scenario that you described is going to happen in our case. He told us that it is upto the officer who interviewed you, to follow-up on your FP results (due to the fact, it is done after interview) and then decide. Sometimes, it could happen that the FP results are sent and the Name check is completed and the info is available for the officer to see, but the officer might have missed to look at your case because of his daily schedule (cases that he gets every day).

It's already 2 months from your FP date and you really should have heard already about your GC (assuming your name is not stuck on Name check). You can do certain things to expedite the process. Call the officer who interviewed you and remind him about your case. Definitely write to him (a letter with Attention marked to him - both on the envelope and the actual letter) and also mark a copy to :
AOS Supervisor
Newark DO - 13th Floor

This way if the officer responds, you will at least know if your name check is completed and just waiting for some officer to look at it, so the approval letter can be mailed out (or) if your name is still stuck in the name check process.

Please let us know if you hear from them after you write to them / Info Pass appt.
 
I have read several times from this forum that you could do a walk-in to your DO and have your biometeric done once you have your notice letter and it as past 90days after you applied.
Go with a copy of you RD and atleast one form of ID which could be your passpost.

I have a family friend in chicago who did a walk in on the 88days and had her biometeris done and also got her iEAD same day

I am not too sure if this will work after the interview but there is no arm in trying

Follow your instructions, I made an appointment by INfopass tomorrow. i will ask about biometrics and correct information on my EAD card. Also I will ask about time line for my case.

fingerprints and biometrics done after INfopass appointment

Hi all,

yesterday I went to talk with an officer about my case, he immediately gave me an 6-day open appointment for fingerprints and biometrics. I went to take them in the same day.

About my EAD card, he gave me another EAD form and asked me to send it back to USCIS Missouri service center, he advised me to enclose an explanation for sending my card back. I did what he recommended after copying my EAD and its enclosed letter.

In the afternoon I received an email from USCIS, saying that my I-485 application was conducted by an interview. They will inform after making a decision.

Thank anyone here, I will post my experience when I recieve information from them.
 
Congrats, Molly. Good for you that the officer could schedule the FP and you could take it on the same day. Some DOs don't do that. You're at least lucky with the EAD.
Please let us know when you receive the corrected EAD card and Good luck with your namecheck.

Actually I was thinking, since next month is my second anniversary, and from my understanding, if the GC is approved after 2 years of marriage, then I will get an unconditional GC. So in a way it is kind of beter for me.

But I just received a phone message from the officer who interviewed me, that He could not locate my mother's name. Which I don't understand why because all the forms as well as my birth certificate has my mother's name on them. But anyway He said, I need to go to the DO to give that information.

Now what do you think, Should I wait till next month and if It's OK to do that what is the risk, should I go right away, should I make appoinment through INFOPASS?

Any suggestion?

Go to your DO with the documents right away as per instructions of the officer. If the officer asked you to do so, then do it. As part of the supportive documents at your interview you will have the same documents and all the originals.

I would suggest doing a walk-in for FP with your I-485/I-765 letters. Tell them you haven't received your appt. letter yet and I am sure they will be able to help you. It worked for me.

Re: taking the docs to meet the officer at DO right away, Cherr is correct. When the officer called you, did you write down his name and the day (appointment) when he asked you to meet with him? If he did not specify an appt, then try any of these:

1) You can make an InfoPass - but from my experience, it takes a min of 2 weeks for an appt. If you don't want to wait that long, you can:
2) Call Newark DO at 973 645 2437 and ask for that specific officer. If he happens to answer, then you can ask him for an appt. If not, leave a message and hopefully he will call you back with an appt date. If not, call him at least a couple more times and leave messages.
3) I'm not sure how well this will work, but if Newark DO is not too far for you, try walking-in and go to the 13th floor to directly meet with that officer. To the guard on 13th, tell him you already had an interview and you were asked by the officer to bring some important documents.
But if I were you, I would try Opt # 2 first.

I was going to try walking-in tomorrow, it's about an hour way. But I guess I would try to call first in the morning tomorrow. And I will certainly keep you guys posted.

One more thing, If I have to make app. through Infopass, can I get to choose the officer, or they will give any officer that is available. I am afraid to deal with another one, because the one who interviewed me seems very nice and so helpful.

Sorry.. you cannot pick an officer for the InfoPass. We wish it was that easy, though :)
FYI : When you make an InfoPass appt with the Newark DO, you will have to wait in a long line on the 3rd floor (depends on what time of the day, you pick your appt - earlier the appt, shorter the wait) and when it's your turn, you go to one of the windows where you are called. Remember to print and take your appt notice with you - the person at the door on the 3rd flr, will check the time and date of the notice and only then will let you in for Infopass. I've heard that the officers at these windows are not the ones who usually conducts interviews.

I follow your advice, This morning (4/11/06) I call the DO newark first thing in the morning. But I could not get connected, nor leave a message. Without wasting more time, I went to the DO Newark. Per your suggestion, I show the guard the appointment letter for fingerprinting. It works smoothly. Surprisingly it was quite - only 2 other people sitting in the waiting area. "This week is quite week", he said.

I then went to the window 2, and told the lady in front the window. I said Officer XX wanted to see me, while handing the letter to her. After waiting for about 10 minutes, the officer came out and invite me in. Again he is extremely kind and helful. He went through the folder and found what he actually needed when He left me a phone message. So I didn't even show him any document. He asked my passport to be stamped, and He printed out a letter for me to bring when I go for biometric. Of course I have to make appointment first. He congratulate me while telling me that I am free to travel if I want to. I am so happy .. it turns to be much easier that I thought.

As soon as I came down to the first floor, I called the 1-800 number to make appoinment for biometric which is scheduled for tomorrow (4/12/06)

Again, I appreciate all your help and advice. This forum is really great.

I'm a little confused about what you said in the beginning. I thought from your first post on this thread,

that you already were asked to go for FP on 2/1/06 and had your FPs taken at the ASC. And the problem you had was, you didn't hear from the officer after you gave the FPs.

Now you are saying that again, the officer gave you a letter for FP and you made a FP appt for tomorrow. So, did you have your FPs taken or not on 2/1/06? Can you please explain clearly what happened after the first interview on 1/31/06?
You said the officer stamped your PP. Does that mean you are already have the approval stamp? So the next step is just waiting for approval letter and GC. Please clarify.

Can you also please update the progress on your case after your FP tomorrow?

I am sorry if I made you confused. Here's the summary.

06/29/05 - Application package (I-130, I-485, I-765, etc) sent out
07/13/05 - Receipts received
08/20/05 - received a letter requesting birth certificate and medical exam
I responded right away
Beginning Dec - received a letter to appear for interview on 01/31/06
01/31/06 interview date. On the interview I was given an appointment letter for fingerprinting the next day.
02/01/06 - fingerprints.
04/02/06 - received a phone message asking about some information and asking me to come to the office, and see him with the information.
04/11/06 - Went to see him in DO Newark, and being informed that my case was already approved on 04/01/06. So he stamped my PP. He also gave me a letter indicating that I was approved but need to make appointment for biometric.
04/12/06 - went for biometric (which for the second time taken fingerprints).
I also went to change my SS card as well as driver license. All finished, and yes, I am now waiting for the actual card to arrive .

I hope this is not confusing anymore. I have replied the message.

Do you happen to know why he would have asked you to go for FP, the second time? By any chance do you know if the first set of FPs you gave in Feb were all good?
It just seems a little unusual to ask to go for FP, after approval stamp on the PP..
