AOS->CP, AC I-140, NVC questions, please help

Hi, all friends,
I am thinking about AOS-->CP. Supppse that the US consulate in the home country can accept AC I-140, but it also says it will only process it after the NVC processing is finished (what is the content of NVC processing and what can be defined as finished processing? I have no idea at all, any hints? :-) ). Thus, my question are:

(1) When will you mail the AC I-140, after you get I-824 receipt or after it is approval?
(My lawyer insists on after I-824 approval, but since he has not done such kind of case before, I am not sure whether he knows such short way or not, so I have to get some ideas from this forum, :-( )

(2) How can we start the NVC processing? If we can use I-824 receipt and AC I-140, why do we still bother with NVC?
(In fact, my lawyer has no such experience, so he also asked me to fill out DS-230 I & II and sent to NVC, do not know what and why he was doing)

(3) Which agency gives the case number if using AC I-140, the consulate or NVC?

(4) What is the steps for AOS --> CP and what is the approximate time frame for each step? for example, in India or in China. The more details, the better!

Answer: In AC I-140 process, consulates have nothing to do with NVC. AC I-140 via consulate and CP via NVC are two seperate processes.

Answer: First answer what consulate do you belong to? Does your consulate accept AC I-140?
If your consulate accepts AC I-140 then it means that ONLY I-824 RECEIPT is required. IF your cnsulate does not AC I-140 process then you have to wait for I-824 to get APPROVED and then follow the regular CP process. First answer the above 2 questions.

Answer: REad above. You dont need to bother with NVC if your consulate accepts AC I-140 process which also means your consualte accepts I-824 receipt and does not require I-824 approval.

Answer: For AC I-140 it is consulate and for regular CP it is NVC.

Answer: I-824 receipt - 1 month and time to get interview from the time of you get I-824 receipt and apply with aC I-140 packet - 4 months.

Add another 2 months to get mandatory name check clearance for all CHINESE (random for Indians).

Please review te above answers and search by your name to find answers given by other moderators to your repated questions from the past.

After reviewing your past 6 months postings, I realized that your consulate is guangzhou. What you need to find out is if it accepts aC I-140!

Yes, my consulate is Guangzhou and I am still trying to figure out whether they accept AC I-140 or not. Someone says yes, someone says no. I also sent email to consulate directly and no response yet, :confused:
Meanwhile, since most friends posted experience here are from India, so I would like to get some idea about the time frame.
Since my lawyer (maybe many other lawyers) are reluctant to go this way, then I have to figure something out and fight for the rights I deserve. When I-485 can be submitted concurrently with I-140, the lawyer suggested not to submit concurrently, they submitted only after my insists on that. When I want to switch to CP, the lawyer insists on I-824 approval and requested me to fill out I-824 as well as DS-230 I & II and told me to wait for NVC. Now I am not sure whether they know AC I-140 or not. Of course, they know money... :p I cannot escape from them since they have all my materials... :mad: So this time, even the consulate accepts AC I-140, I have to teach the lawyer how to prepare, what to prepare, and so on... Seems that I become a lawyer also... The only thing they can do is to certify it and fill out the form (Tell you one fact, the DS-230 they filled for me has more than 10 errors in only 4 pages, some of them are very critical, for example, my address, my education, my parents names, my living places in US and homeland, my name in your native language, etc.... :mad:, so I suggest all friends who apply GC through lawyers double check the forms filled by lawyers before sending out)
Sometimes, after I posted questions, I did not get any reply prompts to my email that someone replied me (it is strange since it works fine last year), I will check again. Again, thanks for your answers! I do appreciate your and other friends' help to make this forum a great help to everyone!

SOrry to hear what is happening with you. It appears that either your lawyers do not understand AC I-140 or are acting to be ignorant. Probably the first one sicne AC I-140 is something a lot of folks have been using only in the last 2 years since it has become more favorable.

You always have the option to change your attorneys. I would suggest posting your question on murthy.com chat to find out if your consulate accepts AC I-140.

I believe that my lawyer does not understand AC I-140, and also have no hints to prepare for that. Then he may choose the regular path, but that will be too long... :-(
By the way, can we use the checklist on http://www.immihelp.com/gc/consular/ac140.html to prepare all required documents? Do we need more documents?
I have posted questions to murthy.com before, but since I always have classes on Monday night. I cannot have an interactive chat on that site, :-(...

I'm surprised the embassy just ignores your email. My experience is that consular posts usually reply in a week, 2 at most. Have you tried calling the Immigrant Visa Department of the Guangzhuo Consular Post directly? Ask them about AC I-140 in general and about your email.

I have read somewhere here that Guangzhuo accepts AC I-140, but it's always a great idea to double check with your consular post. If they really do accept AC I-140, I'd ask them for a checklist of things to send and bring and a detailed process that's involved in getting your GC at Guangzhuo. All consular posts have they quirks and sounds like your attorney has no clue in the process.
