confusing question...does someone know anything about this?

i have a question. I've been on an H-1B since Aug. 2000, however, i was laid off around April 2001. I was "out of status" for three months before i landed a new job. Will the three month period have any negative effects on the processing of my green card (which is going on right now)? Will i have to go back to India for 90 days in order to apply for permanent residency (read it somewhere) or will i just have to go there to submit my stuff at the consulate? If someone knows anything about this situation, please let me know. I'd really appreciate it. Thanks.

I DONT KNOW BUT WILL TRY AND FIND OUT FOR YOU

gorgeousblues, if your green card is employment based you can post on the employment forum this is family based green cards.
If you are family based and an immediate relative of a USC, there is nothing to worry.
Good luck,

Congrats to you gcaprovedhar !! I had my interview in Chicago the same day and was approved too ! Don't worry for the case status online, they're kind of slow to update the thing. My I-130 surprisingly was updated the same day, but not the I-485 of course. Enjoy your new status, go celebrate !

Ema.

thats a good thing that is how it works first it dissapears for a couple of days then when it comes back on with a message saying that u have been approved and ordered a card followed by another message after couple of days saying this case is been approved and an approval notice was sent to u thats ur GC, hey emma what does ur online status say did it disappear or what.

As cherr mentioned, If your GC is based as an immediate relative to a USC, your illegal stay would be pardoned. If it is an employment based GC, then i think there is a 180 day rule and you might want to ask that question in the employment based GC forum.
