Hi everyone,

My friend just submitted her AOS (husband USC). The thing is, she has a ticket for park regulation 1-03 a3 "in dark after hours" in NYC last year and failed to appear in court last december. Now, she wants to fix this. it has already been 5 months since the court date. is that considered a criminal case? will she be stuck in the FBI name check?

What could be possibly done with this when she lives in a different state and going to new york is not an option.

Thanks everyone!

She can do search like "http://decisions.courts.state.ny.us/search/query3.asp" on what is the status. Or just go to the court and ASK about the status of the case.

Thanks for the reply kittenkat. She did call the court yesterday and they told her that they have issued a warrant for her arrest and now she is so devastated about it. She doesn't know what to do. I told her to talk to a lawyer but its gonna cost her though.

Will the warrant appear in the FBI name check? they never finger printed her though.
I'm wondering what's gonna happen to her AOS.

This is so sad.

All I can say she has to talk to the good lawyer. Paying $100-200 for consultations is NOT worse the big problems in future (and possible problems with CIS). I think CIS may know about it from the name check, so if she'll try to hide it she may be banned from immigration benefits.

??

She is in good shape brother. Missing her court case was a good thing. Everything will go smooth don't worry about it everybody has forgotten the court case by now so you are safe.

I REALLY hope you are joking.....aren't you ???.....

Well my friend called the Criminal court again and she was told that the only way she could settle this is to go to court and pay the fine. I guess she'll be going to NY soon before her green card interview.

Thanks everyone!

She better do it BEFORE the interview and she should take ALL papers from the court that she settled. Otherwise she may be getting RFE.
