Hey guys,

Looks like my number will be on for April. I am in OPT right now. I was thinking of applying for H-1; that again happens in April. If I dont get a GC, I would need H-1 to live and work here. Is there any harm in applying H-1 side by side this AOS process?

Thanks in advance for your advices.

My situation is like yours. I think it shouldn't be the issue. May be be someone in this forum put some light on this.

There is no harm on applying for H1 and AOS, consider these as two different applications. If you get your GC, you abandon your H1 status (since you don't need it anymore), if for some reason you don't get the GC, at least you have the H visa.
Have you already gotten a sponsor for your H visa ?

Thanks matutelandia

Actually, I am the principal applicant and I have my wife too. We have jobs but they are most likely not sponsoring H-1s. But there are angencies who do H-1 for you and place you. We were thinking of joining one of them.

One more question, we are on F-1 visa. Do we have A#? Somebody suggested that A# is the red number on the visa.
And I have EAD card for my OPT which has the A#. Is that the number that I should use on my AOS application?

I don't want to be the pesimistic here, but getting an H1 visa is not as easy as you think, it is not matter of "applying to an agency" and wait for the visa, either you do it through an agency or by yourself, you still need an sponsor, and it has to be done by April !!!! last year all 65000 H1 visas were given in the first two weeks of April.
If you and your wife have a clean record (never been out of status, or working illegally, or felonies, etc) then there should not be a problem for getting your GC approved. Maybe you have enough time left on your OPT until the time of the interview.
It is my understanding that the A# is given to you only when you apply for residency, the A# in your OPT card is only temporary and even if you put it on your application they will give you a new one.

matutelandia,

i know what you are talking about..and i also know its not that easy...but u can learn more about these agencies....it is much easier than u think...it has definitely become harder these days due to the downturn....believe me...they train u for a while for a particular position...and they place u...u have to be ready to go anywhere in the US though...

i do have enough time left on my OPT...its upto November this year...so i will take the risk...and its not about anything else (like out-of-status or crimes),,its the time...i hope i make it in time...

so do you suggest i write that A# from that OPT card or keep it blank!!

Ma US mai chu ra AOS garna sochera chu... tara 4-5 month am bhaucha bhaudiana, ke bichar cha tapai ko?

Yes..375 is the DV fee per person...so thats separate...
the AOS fee is about 1010 per person which goes with the application...
