My 140 has been approved just about a week back (see signature for details).

I've done finger printing on May 21, 2004 and haven't recieved notice for code 2/biometrics. Also, I did not do medical while submitting 485 application.

My questions are

1. that when I can expect some progress in my case.

2. that if it makes sense to plan medical without getting rfe and keep it ready. My attorney says that medicals that are not submitted along with 485 application are valid for 1 year only. (if submitted valid forever).

Your lawyer is true. If you do not enlcose your Medical at the time of 485 filling then they are valid till one year. Prior it was similar for everthing, I mean even though you close you medicals. But due to back log they removed that clause or they do not consider.

Coming to your question. You will be getting biometric pretty quickly. But getting RFE saying 'Medicals needed'. Its up to your fate. There is no time frame. So be ready. I know getting appointments is difficult but one suggestion, do not plan kids for next six months. Because your wife cannot take MMR and other test if pregnant. I hate this, not planning just for the sake of GC. but no other way or can go for medicals which will be valid for one year. You will see many people not planning for kids until they get GC.

Why haven't you submitted your medicals along with your 485 yet? I did my medical and submitted my 140/485 together per my attorney. I dont think you have to wait fo rthem to issue an rfe. I think you could send medical exam in certified mail to NSC with a cover letter and copy of 140 approval & 485 receipt now than to wait for an rfe form USCIS.
ABout predicting how USCIS might process your case.. God only knows. One thing for sure is that USCIS is predictably unpredictable! :rolleyes:

plastic_card, I agree with your opinion to keep the medical ready while waiting for the rfe. I'm sure they will not make a decision on the case without medical. So sooner or later we're going to do it.

sriram1975, I did not do medical at the time of filing because I had to spend my money. My company does not pay for immigration medicals. Now the attorney thinks that if we send with all relevant docs but without rfe, there are 100% chances that it will get misplaced. He has experience of doing it and does not want to take chance again.

Getting appointment from a reasonably priced listed immigration civil surgeon takes time. That's why the question if I can do it ahead of time..
