Anyone was Denied a Drivers License because names do not exactly match?

So we went to the dmv with employement authorization and security card on hand, thinking we could get a drivers license, but of course things dont work out like you think they do sometimes.

Apparenlty in the EAD card there is a middle initial to my wife's last name. She does not have a middle name, so I do not know why there would be a midlle initial. The S.S. card has the exact name on the EAD CARD with the exception of the middle initial. We were told that the names had to match exactly, and therefore we could not apply for a drivers license.

Anyone have this happen to them in the state of new jersey? or any other state?

Try another DMV office.

Also, inquire at USCIS why you have a middle initial if you are not supposed to.
 
I called USCIS, but they say we have to resubmit the I-765 to get the name corrected, and to make you it was their error, How long is that going to take??!!!!

I also called NJ's dmv and of course the operator told me this was standard practice, but I think she said that so that the DMV office did not look bad.

I have no idea what to do. I guess I have to call my lawyer.....oh

ND FOR I-485 NOVEMBER 20 2006

You didn't read what he wrote carefully. :o He said that they had their EAD card and Social Security Card. They don't have a green card. That is a big difference. :eek:

They would need to either get a new EAD card as well as make sure USCIS has the proper name in their system so that further NOA's and the green card will reflect the proper name. :o

Write USCIS and inform them of name error and also call. They should give you a reference number to the call to indicate that you have informed them before you resubmit the EAD. Maybe you can take Social Security Card and 2 other verified documents to the DMV and not use the EAD. A lot of people in this process don't even apply for EAD's and they can take their SS card and passport and other documents and get driver's liscense. You don't need an EAD to get your liscense. Check it out and see what you find out. There is a way around this while USCIS corrects your EAD. Also, I would find a job and then resubmit my EAD because USCIS could take forever correcting it like they did when they had to correct my name corrections on various forms and I still have'nt gotten my green card because they made a name error on the I-551 and my interview was approved 12/7:o
 
On the NJ DMV webiste: it states that you need 6 points of id. if you are not U.S. Citizen:

You can use:

Primary ID -
Passport with INS verification with valid I-94 4 pts.

Secondary ID
Marriage Certificate no copies- 3 pts.

Social Security Card - 1 pt.

along with proof of address. So is name on lease or bill ?
