I don't know if you guys have been following my case. Basically, haven't had any RFEs, and got a "your case is undergoing detailed review" response to my I-140 inquiry. I wasn't getting much help from my lawyer, so I contacted the old lawyer, and he sent me this:

".. your case should have long ago been referred to Division XII at the CSC to
get resolution. If this hasn't been done yet you should ask that this be done. I agree with you that based on the processing times your case should have been resolved by now. Best of luck..."

Anyone have any idea what this means?

Thanks

UN,

Thank you for your help!! It's amazing how you have an answer for everything. I read that murthy bulletin too about the "detailed review". I don't understand why the 140 would be held up though. Why is my application special? Like I mentioned, a few others at my company, with the same degrees/qualifications/experience got 140 approval.. Do you suggest I wait out the 180 days then?

I contacted my congressman.

Should I forward this info to my lawyer and request to enlist Devision XII help like mentioned? I have no idea.

Let me know what you think.

Thanks in advance!!

btw, I don't have all the answers, I just know how to research a little bit better, something that is very important with my job. :)

well .. lets just say that you spend the time and effort to "research better" for other people who you dont even know. Thats gr8 service in itself. Excellent stuff UN - we need more people like you to make this world a better place :) - not mentioning a few like u in USCIS as well ...

Dude, Well said.

UN is really special to this forum. I am kind of a calm reader, but see all the valuable suggestions from UN.

Could you/anyone pls give a thought/light about my scenario.
140/485 con current labour subs. end of march 2004
Rfe for 140 in mid october (i think for degree certificate, evaluation and w2's)
replied in 1st week of jan. Since then no LUD/nothing. Only says recieved ur response.
Called up lawer to find the status and he says waiting info from overseas and may be for Degree certificate check.

What do you think???

I too got a response for my I140 email inquiry from Congressional & Customer Relations Division XII - with the message exactly as yours.

According to my knowledge the name checks are notoriously unpredictable and can take 2 weeks to 2 years.. So I am kind of worried. Is there anyway we can influence? And anyone knows why are they doing name check for I140? It does not make any sense to do Name check for I140. I can understand I485 but why I140? Anyone with an explanation?

July,

At this point, the more I looked into it, I really doubt it's name-check related. I-140 detailed review may be financial statements, W2s, education stuff (transcripts, etc.), or experience... I just wish they could give us more info..

I called my congressman, to see what he can do. I'll keep you updated.

Good luck!

It is due to name check, I believe.

I got same reply for my I-140 from CSC a couple months ago.

My department manager called CSC in January. They told her the reason was name check by FBI. I sent email, fax and regular mail to FBI but have not yet got any response. My manager called CSC again last week and asked them to process I-140 based on Yates December 29 memo. But CSC person said delaying 140 won't affect anything, including travel...

I contacted the director of the International Center at my university. He said Yates memo is not a good document because it is about EB3. I told him that the memo has two subjects: one for Eb3 and the other for rescinding the Ohata memo, and there is no reason to hold my I140 up with my I485. He agreed to call CSC this week. However I do not expect it is going to help.

Tired of Waiting

Try contacting your congressman as well. They have some pull.

I did, and am still waiting to see if there are any results. Thanks for the update. Good luck!!
