I applied for 130,485,765 and 131 in June 02 of 06 had Biometrics done on June 19th. Interview with my wife on Aug 2nd of 06. Officer said decision will be mailed to us. He absolutely had no reason to deny atleast that's what i felt(but he is the decision maker in this case as that's his job).I did my interview even before i got my EAD. My EAD card just arrived in the mail today and is valid till 12/27/07. I just don't understand this. I have read post after post and everyone says that they get their EAD right away and it is taken away at the Interview. In my case the officer could not believe our appointment was so early. He just could not believe it. My lawyer says these are moving slowly as they might be doing a more strenous background check as i applied on from a student visa (F1). If anyone can offer any input that will be great.

Chill out. It's the name checks. Officially they will tell you 3 months wait, unofficially it could take up to 6 months or more. My name check took 4 months; I asked the officer when my interview ended. Check my timeline in my signature, I was told that my name checked cleared in Feb/March 06.

I wouldnt completely agree with the fact that your previous status as an F1 would matter. :)

there are a # of cases who have been approved with prior status as F1.
As can be determined from various online posts, the interviews are held quite early these days compared to what it did earlier. There must be more to this.

If you think you provided enough documentation for your application, then there should not be a problem.

let me ask you, have you had any RFEs?
Also confirming you applied all applications in June and received your EAD now?

Hey AJ,
My friend from college filed in Las Vegas, NV. She had her interview within 2 months(?). She is now stuck in name check. Just give FBI/USCIS/DHS some time. They might not be as efficient as FedEx or UPS, but they should be able to get the job done. So give it another month and call the 800 number to check.
 
TXGIRL no requests for RFE's have been made. My lawyer tell's me to chill out too and that it is the FBI name check that is taking so long. I am totally comfortable with the time frame. I understand there are millions of people that the INS needs to work for. I was just confused the way things have been going for me. Yes my EAD did arrive 6 months after i applied for it.

AJ, :confused:

Your lawyer is a wimp. Your EAD is supposed to be send to you within 90 days of receipt of the application by USCIS. This is even with a name check pending, because USCIS has mandate to get you the EAD, and deal with the name check for the AOS. :rolleyes:

If your lawyer told you to relax, he just didn't want to be bothered in doing the hard work of writing letters and put heat on USCIS. I would be worried if he were my lawyer... :o Your lawyer will need to write monthly to USCIS and inquire on the status of your name check, because FBI clears them and send back to USCIS, but officers there just sit on them until a letter comes and inquire,then they find that the name check has been cleared months ago.

When your lawyer writes letters, USCIS is forced to research and send him or her an updated and latest information on the application. So, be rest assured that these letters can help your case, but if you believe your lawyer's word, then you are the getting screwed.... :eek: and by the way, you are paying him.. :rolleyes:
 
Al, I agree with you 100% I have been doing most of my research on my own. I have set up my account portfolio online at uscis and check the status daily. The last time they worked on my case or atleast the updated date is 01/18/07 which is pretty recent atleast with INS standards. I will get on this case and my lawyers ass once week 1 in Feb goes bye.

Hi:

Adjusting from a student visa (F1) does not necessarily delay your case. Absolutely no truth to that. I know several people, including yours truly, who adjusted status in just 2 months from a student visa. Every case is different, and you are probably just somewhat delayed in the name check.
