Yes you can recapture your time Spent out of USA, but it has to be without pay. Normaly a persom who comes to USA after Stamping his/her H1B visa from India never catches the same day flight, so the time you spent out side USA before entering that also can be recaptured.

Yes I got back ~ 9 months spent in India during my 6 year period.
I am not sure if getting paid or not matters at all. Basically the attorneys have a table format which they attch along with the petition for approval. It has in days out days and total remaining days.

With reference to some messages here differnt people are saying differnt things. Someone says it has to be without pay, Someone says it doesn\'t matter. Someone says it has to be work related, my other friend consulted some attorney in NY and he said it shouldn\'t be work related or vacation (didn\'t mention paid or without pay) Ok let me tell you my situation and somebody tell me how many days approx. I\'ll get. My visa was stamped on Feb 27 1996 but they put Jan 15th the date on petition on my visa and I actually landed in the US on March 21st 1996 (around 65 days), I took 3 vacations approx 30 days each (total 90 days out of which 30 days where paid assuming I get 10 days paid vacation each time) Now I know for sure I can claim first 65 days, but out of remaining 90 days of vacation since 30 days were paid I can claim only 60 days out of 90?
When your lawyer prepared the table how did he mention situation like this? Also was it vacation in your cases or was it job related?
