Anyone file PERM today?

hi, really bad news, rerun killed my case

my case is in audit review, but now it is denied. do not know why, do u guys know why?
they changed the decision matrix, now it is totally worse than before.

How do u know most of "audit review" cases are denied? The only thing I can think of is that because most of the case filed on March, their Ads maybe alreayd more than 180 days old now. So the dates will make them denied, in addition, maybe the PW is more than 90 days old. Just a thought.
 
PW validity

FYI-

PW wages are valid for minimum from 90 days to max 1 year as determined per the SWA.

PERM law requires non expired PW. So 90 days counter applies ONLY to those PW determinations, that have expiration date after 90 days of determination date.

would you like to let us know why you say most of the audit review cases have been denied? Also would you like to share some info? will those cases be receiving notice of denial? i thought they are expecting to receive audit review notice instead.

Some guys reported that 'Final Review' just came right before they got certified. I'd say that's good news for you.

2. My current Audit Review --- >> changed to "Final Review"..

I dont know what to make out of this... I am just hoping this does not screw up everything.

Any idea what Final Review means ???

My case has changed from audit review to final review.Is your case in chicago or Atlanta?
Does anybody know what final review means? Have we bypassed the audit or can we still be audited at the final review stage?

My case was to Chicago...
Based on prior reports, final review means you have supassed the Audit thing.. But considering they got this new matrix, nothing is clear yet.. I guess we need to report things here asap we learn new things.

Rajaabhi and jay2005,

You both are right, when you reach to "final review" status you are done with auditing stage. Now your case is in COs review stage. After "final review" there would be "certified" status which happened for user helen999. However, even if you are in "final review" status, CO can still ask for few documents like recruitment report etc which happend for user qqy.

In otherwords, it looks like you guys are almost done with LC.

H-12 was yes or no --> we said NO (basically that position needs a biz necessity)

Hi All, PERM gurus, and the members of this forum:

I planned in applying in PERM. My NON RIR labor is pending in either TWC or DBEC from Dec 2002. I would like to withdraw my application and convert it into PERM. Do you guys think its worthwhile doing such? What would be the consequences if for some reason it gets denied? Also I heard that I will lose the PD, and if thats the case, should I wait (I dont know how long) or take risk and file in PERM?

Any suggestion will be greatly appreciated.

why do u want to withdrawa it. Just hold on to it and apply a new perm app. this way it will be safer
 
Denied!!

My case which was denied earlier was re-run again. The HR got an email asking about the petition and she reponed back today. The initial petition got denied without even the HR getting the email. Hopefully, now i get certified.
 
Bachelor + 5 years Requirement for EB2.

My position requires Bachelors and 5 years experience. Position is Technical Lead, I have 4 year Bachelors degree and 5 1/2 years experience before joing current company. I would like to file under PERM to be eligible for EB2 at 140 and 485 stage. Has any body with this requirement given a shot for PERM, Did your attorney agree to proceed with the case. Please share any information if it is a good idea to try PERM or not.

we filed yesterday (BS+6 years). Employee got email and responded yesterday itself. Today my Attorney told me that it is 'Final Review'.

EB2 (BS Equivalency)

Hello Gurus,

I have a question regarding PERM EB2 Filing.

I have a 3 year degree from India plus a 1 year advance Diploma in Computer Programming. Trustforte Corporation (New York) did my academic evaluation and gave me an equivalence to a BS in Electronics and Computer Engineering.

I will be having 7 years of IT experience in August 2005. Although I have a RIR EB3 application filed from NJ with a PD of Feb 2004, I wanted to go for PERM.

1. Do you guys think if I will qualify for EB2 on the basis of BS (Equivalence) + 7 years of experience?

2. Has anyone come across a similar case (filed or approved) where the candidate has an equivalency rather than having a 4 year degree?

Soon I am entering the 6th year of my H1B. Therefore I need to make a decision as soon as possible.

Your advice will be highly appreciated.
