Anyone file PERM today?

I still need to wait

I've been pushing my lawyer pretty hard. But there are still some delays. They are going to open the SWA job order today. I need to wait for at least another 30 days.

How about you? what's the earliest day you could submit? Yes we should share our experiences.

I am also waiting for the response from lawyer. The lawyer becomes very slow after he gets the money.

By the way, according to another thread, we have to wait 30 more days AFTER the SWA job order finishes, which means a waiting of 30+30=60 days.

Am I correct?

Yes you are correct. The application filing date should be 30 days later than the job order end date.
 
Two case denied

My employer filed 2 cases today, both for programmer analyst, got denied in 10 mins after submission. No clue why they denied. SWA order posted in Jan and news paper in jan 30& feb 6(cons. sundays same news paper). and website posting, internat ad in Dec. Employer going to wait for the reason and will file after getting the letter from DOL. DOL not giving reason for deniel immediatly.. but seems they are sending only by mail.

Keep us posted for the deniel reason... I am hoping to submit mine soon.

They filed one case with B.S with 5 yrs exp; other case M.S with 2 yrs... so it is EB2.. they said, in case officer not satisfied with min. requirement they will ask for Business necessity letter. They won't simply deny. Any how I will post the reasons after receiving the letter..

what about the prevailing wage they submitted? does it reflect the new level 3 or 4 in Perm in order to qulify for Eb-2?

They used the wage obtained on 01/07/2005... which has only two levels and they used level II.

that just does not make sense.....

such a quick denial sounds more like software glitch or something -

DOL said -they expect 45-60 days time frame to process app that are not called for audit...

anyway - hopefully its an error that CAN be corrected......

The denial sounds unthinkable.Did your company have a layoff within 6 mon.? If the 2 level system was used, then the lawyer should get fired.

according to dol FAQ at www.plc.doleta.gov employer can use the prevailing wage obtained before March 8 under II level system, if the wage source is other than OES..

It may be the "Progammar Analyst" title for EB2?
 
Job Order in NJ

Does anybody know how to submit job order in NJ? My lawyer just faxed a job order form to NJ DOL, but did not get any response. How to know whehter the job order is running or not?

The lawyer said that the attorney is not allowed to be involved in job order submission, so she cannot inquiry the status and only the employer can do that. Is it correct?
 
the reason for denial are 1) Prevailing wage and 2) notice to bargaining representative.. My employer said even though they selected N/A for bargaining representative check box.. dol system takes as "No".. I think dol will fix this error.. and they are going to submit again with 4 level prevailing wage on Friday..

Hey, ram-

Just check with my lawyer, he doesn't agree with 30+30 day waiting period for job order. During 30 day post period, employer actually receives responser and it just doesn't make sense for another 30 days period. Can u confirm this source. Thanks advance!

30-day wait is from the end of recruitment, not at the end of the 30-day posting of the job order with the SWA. My schedule so far has been -
March 4, 11: Sunday newspaper ads
March 8: Submitted request for PWD
March 8: Other recruitment steps initiated - 10-day internal job posting, online ad, company website ad & employee-referral program
March 15: Received PWD
March 18: Filed job order with SWA
April 18: Completion of mandatory 30-day wait period post-recruitment & 30-day job order
April 19: File PERM application

You cannot file on April 19th.. you can file only on May 19th.. please check 12th page of the FAQ. It says " 30 days of the posting must take place at least 30 days prior to filing" also they are saying "30 day job order timeframe must end at least 30 days prior to filing".
