Anybody whoes 140 approved for CP, but files for AOS? (VSC)

My attorney just filed for 485, didn\'t call NVC, will this be a problem? I saw some messages say need to call NVC to send something back to VSC. Please share your experience.

NVC will send a letter to your lawyer asking whether you will do AOS or CP. Make sure your lawyer responds to that. That will guarantee that NVC will keep your I-140 file until VSC requests it from them. If they do not get a reply from your lawyer in 30 days, they will automatically transfer the file to the US consulate in your home country; that will cause huge delays.
 How do I know? This is why I\'m waiting with Dec00 RD.

My corporate attorney did not do anything and my file has gone to consulate

My I-485 has been filed but CP approved I-140 has been sent to consulate. Attorney tells me not to worry. Will this definitely delay my case? Can I do something? My I-485 was filed last month.

Please advise.

Do we need to ask IIOs if they have our I-140 at VSC? I\'m thinking if it\'s possible to ask IIO to send a request to transfer I-140 from consulate...
 
I will ask my attorney to calll/write to VSC to get my file back from consulate

Just trying to avoid subsequent delays.

f e, my lawyer said they got the original 140 approval notice, and told me it is not necessary to notify NVC. From your message, it seems VSC need all the 140 packages back from NVS, original 140 approval notice is not enough, is that correct? If 30 days passed, what options do we have to expedite the delay? By the way, did you get 458 receipt? EAD and AP approved? Thank you.
 
Here is the story..

My corporate attorney did not respond to anything from NVC but filed my AOS. According to them, the the past there have been no delays. But I don\'t agree - my attorney is talking of 12 months process and currently cases of March 01 are getting cleared. In the future the processing time will shorten. Therefore delay in my case will be transparent to their view of 12 months processing time. I will shortly ask them to write to VSC to get my file back from the consulate.

I haven\'t yet received my AOS receipt - but just to let you know that the prolonged receipt cycle is also gradually reducing. Last posted was Nov 18, 01 RD.

Hi f e,

I was exactly in the same boat that was being discussed by you guys.
My 140 was approved for CP, but I chose AOS and got my receipts very recently.
Looks like my lawyer did not receive any thing from NVC yet(I guess)
So he did not take any action regarding the file that was there at NVC
and he insists that VSC does not need any thing from the packet that was there with NVC and they have everything he needs right with them

What are my options now ? Shall I have to call NVC or Consulate or VSC
Please explain..
