Anybody received their Fedex back from USCIS

I haven't received mine yet. I mailed my application on June 28th (Thursday) and according to Fedex tracker it reached USCIS on July 2nd (Monday) morning at 9 am.

I came to know that USCIS hasn't yet started to send the packages back to the applicants. If we don't receieve the I-485 packages on time from USCIS , and if there is an interesting update(which makes us current again before October 1st) on the Visa Bulletin, then we will be in trouble.

One of my friend mailed his application on Saturday (30th June).
USCIS rejected his application...He received yesterday

One of my friends' attorney received the I-485 application returned by USCIS. Have any of you or your attorney received the application rejected by USCIS due to July Bullettin Update?

It's hard to believe this..How can get it so fast...Based on discussion with my attorney USCIS stii has not made a decision whether to accept or reject July 2nd filings...Did your frein'd atorney actually send the package??? Ask your friend to get the tracking number...tell him not to believe what ever they say...

You are right. I spoke to several applicants who became current in July 1st, and asked if they had received back their applications from USICIS. Almost, 98% of them said "No". Only two of the applicants--a friend of mine and Ksapna's friend on this forum--seem to have received their rejected applications from USCIS. My take on this Bullettin issue is that USCIS is going to wait for a couple of more weeks to decide whether to accept or reject all I-485 applications received on or after July 2nd, or atleast to accept the applications received only on July 2nd. But, God only knows how things might take sudden twist? :)

2% of the cases tell us clearly the course-of-action of USCIS. If the 2% of cases were rejected because the numbers were not available in July, then the 98% cases would hear the same reason sooner. Let us have no doubt about this.

Think of the stance of USCIS - it would not wait 2 or 3 weeks to take an action, when it has decided to not accept any applications from after July 2. That would only be sheer violation of its own revised July VB and deeper problems for USCIS. I cannot see on good reason, except logistics, why USCIS would wait for 2 or 3 weeks for taking a decision.
 
what happens if I am not in US?

I have not received my application from USCIS after July 2 rejection. I am planning to go visit my family soon. What happens if I dont get my application back before that?

Is there any chance of PD become current in August 2007 and what will happen if I am not in the US.

Any help is appreciated.
 
It would be an important factor to know if the applications being received are from June Bulletin or July Bulletin....

Is your friends priority date current in June or in July? I'm wondering what would happen to the applications that are current in June and were delivered on July2nd.

2 possible scenarios for July's filers

I think they just accumulate July's cases and have been waiting when the stream of them is low, sometime at the end of July. When the stream of them is low they dedicate some staff members to sort them and ship back.

I can barely believe that USCIS comes up with excuses and new update kind of that they are scared of AILF lawsuit and decided to process July's cases.

It is going to be more time/cost effective than to ship them back during whole July.

IMHO July filers can rely on the one possible scenario, that UCSIS will not do processing of July's filers, accumulate them will not ship them back till October 2007, and based on the October's 2007 bulletin some of filers will be processed who is current, and old/current fees will be used, the rest of cases is shipped back.

I agree this seems a resonable prediction, but the problem is the fee revision. Will USCIS accept the July applications in October with old fee?

I don't think USCIS will reject I-485 applications filed in July. Here's a scenario to show why I think so:

Let us say DOS publishes a Visa Bulletin on 15th Mar 2008 stating the Priority Date of Jan 2006 is current. At this time, let us say 8000 of the 14000 visa numbers availble for February have been issued, and Visa Bulletin has issued based on the availability of 7000 visa numbers in Febraury and 14000 visa numbers in March.

Let us say, subsequent to this Bulletin, 7000 I-485 applications were filed in February, and 15000 applications were filed in March. The USCIS, at this point will process the 7000 applications in Feb and the first 14000 applications in March, and hold the remaining 1000 applications until the next month. In April, depending on the Priority Date, these 1000 applications will be processed. While the USCIS will hold these applications and not process them, they will NOT reject these excess applications.

The update to the Visa bulletin issued on the 2nd of July states that "there will be no further authorizations in response to requests for Employment-based preference cases", and not "Priority Dates for EB categories have been updated to U". Nor does it state "Priority Dates for EB categories are no longer current". As I am not a lawyer, I am not sure if they mean the same thing. IF they don't, then USCIS should accept applications and not process them, as they would have done in the absense of the updated bulletin, and NOT reject them.

FYI. USCIS already started rejecting applications. One of my friend's application was bounced back!

Your PD was current in June VB. Not sure why you did not file I-485.

I don't see any one substantiating when they say the package got bounced. Can you give more details.
1) Was your friend's PD current in june and
2) When was his package received by USCIS.
3) Did he file I-140/I-485 together, if so did he get everything back or only I-485 papers.


FYI. USCIS already started rejecting applications. One of my friend's application was bounced back!

I need to find out more details from my friend, he was current as per July bulletin issued in June and his package was received on July 2nd.
