After waiting pathetically and praying frantically for last 3 years I'm at a point where I feel totally lost. I'm trying to know if there is somebody other than me in the similar situation.

My 485 notice date is 11/29/01
Had my FP done on 04/30/02 --> The only one.
Received a RFE for Medical and Employment on 06/14/03
RFE response received by BCIS on 07/23/03.

Ever since then there is no communication from BCIS. I have got 3 EADs and APs so far. But, other than this the case appears to be in cold storage.

My lawyer sent a query in Jan 04 - Reply: Case is under process not approved yet.

I contacted the local senetor in Apr 04, they called back in late May with the information that my case is still pending with Officer and that BCIS asks them to call back to check the status again after 60 day. Lady calling from Senetor's office promised that she'll call back to check the status again in 60 days.

I called my Lawer again to send another query in mid July 04 - so far haven't received any reply.

The furstration increases when I see people getting approvals (not that I'm jealous of anybody). My friend who filed his 485 in October 02 got his approval about 15 days back.

Is there anybody out there who is going through the same trauma and mental agony?

Email Rajiv Khanna with your case details, maybe he can refer to your case when he represents us in court.

Also call the 800 number for USCIS thrice daily and scream at whoever picks up the phone, maybe you can vent out some of your anger this way.

It is really unfortunate to see somebody waiting for almost 3 years for I-485 approval while all the talk about reducing the back log at USCIS continues.

I got approved in on May 26, 2004 (Receipt Date- June 2001). I can feel the pain you must be going through, but alas, we have to live with it. My case was delayed as the Chicago Office where I had my interview in January 2003, did not send the name check request to FBI. They continued to reply to the various enquiries submitted through Senator's office that my case could not be adjudicated as FBI had not completed the security check on me.

In Feb. 2004, I contacted FBI under "Freedom of Information Act" to provide me the status of name check in my case. To my utter dismay, FBI informed me that USCIS had never requested to complete security check for me. After that I contacted US Congressman Dennis Hestert office. Through their efforts, USCIS sent the name check request in April 2004 which was promptly completed by FBI in early May 2004 and I received my approval thereafter.

I wonder if your case is also awaiting completion of security check which might not have been requested by the all efficennt federal agency called "USCIS". Get in touch with your US Congressman's office for help if Senator's office is not very helpul. You may also try to contact the other Senator from your state.

Waiting for security check. Contacted Senators, call FBI etc....i did everything. The only answer i get from INS is......waiting for security check.

here is my case from FBI :" A review of the Name Check Program database revealed that a request from the U.S. Citizenship and Immigration Services (USCIS) for you was received on January
12, 2003, and is currently in a pending status. Due to increased national
security concerns, in December 2002 to early 2003, the USCIS submitted an
additional 2.7 million name checks for processing to the FBI. Although 99.5% of these cases have been processed, we are still clearing the remaining cases.

Have you asked for a special inquiry into your case ?
You certainly qualify for it since the current processing dates (Feb 2002) is more than 30 days of your ND.

Give it a shot and let us know. ;)

I think there may be something that is holding up your case. It may be the Name Check. Send a fax to FBI and make sure they did the name check.

BUT NO APPROVALs.

I recd. enquiry from local office back in April'04 by phone (I don't have anything on the paper so far which i can say it was RFE because it was over the phone) & I answered in May'04.

My status is same since FEB 2002 regd. FP.

I feel everybody's pain. I'm planning to contact Senator but don't know how much he will help.

But keep this thread going on, so we know whats going on.

As I said to Thukralk before you guys qualify for a special inquiry into your case since your RD is more than 30 days prior to the processing date.

Have you asked for one yet ?

Where can I find more info on 'Special inquiry'?
I called USCIS on 06 July 2004 and received a standard stock reply that "Your response was 'just recieved' on 04 April 2004, please give the officer some time to process your case"
 
Even i called USCIS and got a reply after 20days with same standard reply.
" we are reviewing your case....please give us more time"

I did the same thing as you and the officer gave me the same exact reply.
However, he added that special inquiry can not be given to me since the current processing date (Feb 2002) has not passed my RD (May 2002) by 30 days or more ... meaning I can't ask for it until it's showing Jun 2002 but you certainly can !

Maybe not much but at least someone touches your docs.

I asked for special inquiry and got a letter from NSC with standard reply
"we are reviewing you case.....please give us more time"

I tried calling the USCIS National Service Center, they said it is less than 30 days since my last enquiry (on 06 July 2004) hence cannot request another enquiry/ special enquiry....Well, atleast I tried. Will try calling again on 07 August...
