Any used AC21 for future GC.

Hi ,
I am getting my GC sponsored from a future exployer. My i-140 is approved and its been 180 days since 485 being applied. According to Murthy's website, AC-21 can be used for a future GC.
I was wondering if anyone similar to my case used AC-21, if so what are the risks involved.

I did, and the GC was approved (after interview). Keep in mind that I invoked AC21 back in summer of 2002 and therefore it was still very new.

Iam I/T professional working as consultant for the most part of my career so far,
My Eb2 RIR I-140/485/AP/EAD were filed in 10/08/2004 by a small 100 +
employees Indian company. Got approved AP/EAD on 11/2004.
No finger print notice yet. though i got finger printed in 04/2004 when i
applied H-1B Visa stamping.

1. Is this normal NO FP notice yet, what do i need to do wrt to that?

2. I am working with a good client on 6 month to hire position,
and with a good american consulting company as a preferred vendor
which pays $$ on time, the client expects me to join them as an employee
after 07/2005 like i mentioned above my I-140 applied in 10/2004 and is
pending, the current processing date for EB2 I-140 is 02/2004,
Is there any good chance my I-140 gets approved by 07/2005 or
little after that?

3. I have another offer, this is a pure consulting assignment
the preferred vendor to this client is an indian company who likes to
pay atleast 45 days LATE and My company wants to charge me 4%
more on the billing rate and pay me 4% LESS $$ but ON TIME.
should i consider this assignment? instead of changing companies
while GC is in process and the risk of getting delayed and
put up with this desi indian companies till my GC approves?

Please help me decide, tell me what you would do in my situation ?
Please respond to me at the earliest as i need to decide soon,
I dont have much time at my disposal.

The best advise I can give is, stick with current employer till I-140 gets approved. Looks like yours will be approved any time soon.

Please shed some light on this, it would be very helpful. One thing I want to know is that how difficult was it for that member to get the letter(Which USCIS asked).

Future Employment

Can someone tell me what happens if after you GC is approved for future employment, the business that sponsors you is sold to another company, and the new company does not have you in their plans?

That is when you will change your job to another same or similar job using the AC-21. If the case get approved within six months GC would be void.
 
What if the GC had already been approved before the company was sold, do you still need AC-21?
 
No. If your company has no plans for you find another employer as the circumstances have changed and was beyond your control. Nothing to sweat about.

I've applied I-140/485 as future employment from company A. My I140 is pending approval for more than 8 months (NSC) and its been 180 days since 485 being applied.
My questions are:-
1) Did u got any RFE for I-140? If so, could you pls share? I heard that applying I-140/485 as future employment is risky thing.
2) Do you think i will be eligible to use AC-21 without I-140 approval?

Any responses is appreciated.

Did u got any RFE for I-140? When did u apply I-140/485? Are you EB2 or EB3?

I think u are eligible to use AC 21. But INS expects u to work atleast 6 months after getting ur GC.

Apllied I-140 on a substite Labor from NSC

I-140 RD Feb 2004 Approed on March 2004
I-485 RD Aug 2004 First Finger Printing OCT 2004

EAD RD Aug 2004 AD Oct 2004
AP RD Aug 2004 AD Oct 2004

Now if I am eligible for AC21 from CSC...will my case be transferred to CSC.

My application is based on FUTURE EMPLOYMENT and got approval last friday(3/4). Checked the status online.

Here are my details.
LC Filed: 2/26/02 AD:6/22/02
I140 AD: 1/26/03
I485 Filed: 6/17/03 AD: 3/4/05

It's an EB-2 case. No RFE and had only one FP.

Above all, I never worked for the sponsoring employer till now, but will work now.

Congratulations on your 485 approval. Your approval give me some hope to look forward. The thing is i never came across the gc future employment case before. People says that gc as future employment involved more risk. Well,my I-140/485 (RD: 06/2004) as future employment in EB3 category in NSC is still pending.

Here are my questions:-
1) What is your service centre?
2) Any RFE's for I-140?
3) Have u used AC21 before I-485 approval?
4) Is your cases transferred to local office?
5) Have you had an interview before/after I-485 approval?

Please let me know. I would really appreciate your response.
 
Hello hopeofgc,

My service Center is NSC
There was an RFE on my I140 but is is because my company forgot to sent some papers when they filed 140. It wasn't a big deal.
Haven't used AC21.
It wasn't tranfered to any local office also I had only one FP.
I haven't had any interviews before 485 and I believe there won't be any interviews once the case is approved.
