My I-140 was filled in December 2000 (RD: December 26, 2000 and ND: January 03, 2001). We haven’t received anything yet but receipt. I asked my attorney to find out the status of my case but he replied back that it’s still in progress. But others who applied after me under same category, same employer they got there I-140 approved.

Should anyone have any suggestion, please let me know.

You are a very patient person. You have to push your attorney to inquire about your case now! Try to get your filing number with the INS and call the automated system. It will tell you status of your petition. Good luck!
 
Thanks for your suggestion but

I know my EAC # and i have called INS automated system so many times but it still says that "my I140 Petition was received on Jan 3, 2001 and we\'ll mail you a decision as soon as processing is completed".
I have also talked with someone from INS but they said I am a beneficiary and they can not tell me anything.
So, I called my attorney to talk to INS and he replied me that my file is in process and it will talk some time but don\'t know how long... So, I am not sure what to do now..

This is going to be probably a similar suggestion to the one before. What about your employer? Could you ask them to call the INS?

Generally, it is true and very frustrating that mostly we do not have any voice in this process.

I hope you get your approval soon!
 
Talk to IIO

Need to be at the back of ur attor( if there is no reply),then speak to IIO(officer) expecting someone to be goodenough.It has been to long time,R u sure when u check AVM it still says (ur 140 petition .....bla...bla....),since u have EAC # try calling couple of days IIO(as it is tough to get the line).
 
Remedy,

Some IIOs refuse to give information to beneficiaries, while some others do. Keep trying to call them, and hope you are lucky. Good luck.
 
Talked to IIO

Hi all

I talked to IIO today and she told me that the case is still pending but she doesn’t know why. Only she can do is bring up the information to senior officer.
But same thing was told to my employer month before but nothing happened.
I don’t understand that if they don’t know then who does?
If someone has more tips or suggestions, I’ll appreciate it.

Your case is just longer than usual. You did not receive any decision for your case. You should NOT back out and file a new one. Instead, you should ask somebody who represents you to inquire into...
 
Need more input from all of you.

I’ve filled my I-140 in Dec 2000 and still waiting for INS decision.
Is there any problem if I fill another fresh I-140 (same employer, same category, same service center, same Labor)?

change of category from EB3 to EB2

I talked to my employer to fill duplicate I-140 but we don’t have an original Labor certificate. And filling with Labor’s photocopy takes long and some time gets messed up too.

Is there any way we can ask for change of category from EB3 to EB2?
If yes, would it bring file in process?

Please give your suggestions/advice ASAP.

Whenever we call to get the status of my I-140 INS says it’s pending and they don’t know why. Is there any way that we can get hold of any IIO or their senior to get the status of my I-140 or get some information like why is it still pending?

I talked to my employer and he is ready to send some one from our HR department to VSC.
Is sending some one to VSC going to help?
