Any strategies to get referral to immigration court *almost* out of status

I received a NOID and sent a rebuttal with my attorney. The NOID included some mistakes on evidence as well as documented country conditions and omissions etc. Although the rebuttal addressed all of them, I am of course very distressed and worried. I am almost out of status but what if the AO closes my case and they don't accept my re-application??

I wonder if anyone knows any strategies/tactics their lawyers have mentioned about getting a referral to immigration court when I am almost out of status. The rebuttal was just sent and I have several more weeks, while I am still in status.

Any ideas are welcome... Thank you so much.
