Any restrictions for part-time job under TN?

Hi everyone,

I was wondering if there are any restrictions in terms of working time or pay for a part-time position under the TN status (e.g. required min 20 hrs/week)? Also, does employment letter need to explicitly say that the position is PT? Or it would be obvious from the payment arrangement, since it will be given in $ per hour, rather than yearly salary (or it still should be salary?).
I would appreciate any other hints in regards to PT position under the TN. I hold BSME, and applying for a ME position.

You can have a PT position with a TN. The letter should state something about the expected annual salary. Basically the officals need some way to determine if you will be able to make enough money in the US and not be a burden on the government. If you have another TN from another job which is paying decent, then the second TN salary isn't that important. The letter doesn't need to expliciatly state that the position is PT. There is no minimun number of hours to be worked or even minimum $ amount.

Thank you Gunt. I'm currently in US on H4, so I guess this is enough proof that I won't be a burden to the government (since right now I do not work and we are still supporting ourselves with my spouse's salary). Should I enclose my spouse's paycheck copies with my TN application, to support this? Would it be a problem that she is on H1B and I apply for TN status?

if you are already in the US on H4, then there is no need to be concerned about burden on the gvmt questions. There is no need to enclose any info about your spouse with your MAIL IN application. If however you were planning on going to a POE to acquire the TN, you might want to bring the spouse income evidence.
 
If mailin I-129 is used, is there any minimum revenue and net income? For example, a startup company doesn't have big revenue and net income last year. Does that cause any issue?

It can be a cause for an RFE. USCIS might think say that there is "and inability to pay" by the company based on the revenue and net income from the I-129. There is no minimum figure however.
 
By the way, the question of salary has nothing to do with being a 'burden to the government' or not. Non-immigrants aren't entitled to any US government aid. 'Burden to the government' is only looked at when IMMIGRATING to US.

The issue is that a low salary while living in US might increase the temptation to work illegally. If one isn't living in US, then the salary question doesn't come into play at all.
