Any problem at Port of Entry ??

Hi Guys , I need all of you experts opinion on this situation:

A freind of mine who is on H-1B. He register a Sole Proproitery business to sell on the internet(eBay). He hardly got 10 to 11 orders in a year. When I read this forum , I informed him and opened his eyes. He immediatley close the business and all related activities. His I-485 is pending. Now he has to travel to India for a week on H1 visa. Would there be any problem at the Port of Entry?
 
At port of entry, they would look for a valid visa, and passport. Is H-1B based on closed business? My guess is no. Opening and closing business typically involves IRS and not CIS. If at all, it may be an issue during GC interview, but, not at Port of Entry. This is just my opinion. I am not a lawyer.

Your guess is correct. His H-1b is not based on closed business. He has a valid H-1b until Mar 2005 from a employer who has filed his GC.
