Any Paystub alternatives? I only get paychecks

Hi,

INS requested a pay stub for the last 3 months. However, my company doesn't offer pay stubs. I get paid using a company check and it doesn't have a pay stub attached.

What are the alternatives I can submit to the INS interview (instead of pay stubs)? I know I am required to submit pay stubs- but may be something else is satisfactory instead! My company's software doesn't produce pay stubs when I get my salary. So is there other ways. My company suggested for me to buy some software (cost = $600) so I can get a pay stub printout to present to INS along withy my pay check.

So here I seek your suggestions on whether the pay stubs are mandatory.

Do they deduct taxes??Then you are OK.

Maybe try to take a letter for each payperiod form your company mentioning your emoluments, taxes, deductions etc.. Basically contents of the paystub printed on a company letter head.I am not sure but may be this is OK, I think.

Also, INS asked me to bring the company's federal taxe returns for the last 3 years!!! Is there an alternative to bringing the company's private taxes?

Please notice my company prefers not to reveal its very private information. May be INS understands this and allows me to submit an alternative to the company’s taxes for the past 3 years.

It is really funny that your company doesnot want to reveal its tax information. Tell your company officials that they could seal the tax returns in a envelope and hand it over to you. You/Your Lawyer can send them to the INS. Not sure if this will work out!

The other alternative is to try to order your employers tax returns from INS. I am not sure if you can do it.
 
I-485 Interview: Taxes

The reason I am asking for them is because I am scheduled an I-485 interview in Oct 2003 and a list of required documents was sent to me: employer letter, my taxes, employer taxes, W2, pay stubs, and birth certificate.

I will prepare an envelope and make it convenient for my employer to insert the taxes and seal it. I will provide a letter from my lawyer indicating this is required of me. This way the employer would cooperate.

But is there a way to call IRS and obtain a tax report for the last 3 years? Or can this done over the Internet (filling online forms)?

check irs.gov It will take a few weeks for you to receive past IR returns. But you cannot get other's IT returns.
 
IRS will not give copies of your employer's tax return unless your employer signs the release form.
On the pay stub, I think you have a right to get the paystub. Even the fastfood joints give paystubs to there employees. Maybe your accountant can make the paystubs for you. T hope this helps.

Did u attach w2 forms, tax return when you file for 485. Did ur attorney tell you to attach all these docs.
Statment i read below seems that you did not attach your w2 & tax return of past years.

More documents required for married

I did attach W2 forms and tax returns at the time of filing. But the letter I received from INS asks for them again.

My current lawyer told me that in addition to the tax return, INS is also interested in the Tax report for the past 3 years.

Please notice that the tax returns and the tax reports are different things. But they are ALL required at the interview.

To obtain a federal tax report, you can call IRS at 1-800-829-1040.

And ofcourse if you are married, you should provide a marriage certificate and other things. I applied as a single, unmarried person. So I did not list ALL the documents that INS requires from a married applicant.

Both tax returns: Employers and mine

ANS: Both are required. Yours should be for the last 3 years; employer's should be the most recent federal tax return.

ANS: I filed my I-485 using a computer company from which I was laid off recently. My I-485 was filed with VSC. But now found another job in the cosmetic business. Plus my I-485 was transferred to NYC for an interview in October 2003.

My new cosmetic company said she is not willing to write me a letter indicating permanent employment. But she said, she would indicate Full time employment.

But the keyword "Permanent" MAY be required in the employment letter (along with salary, start date, Full time key word, letter head, job description, company seal, signature, and title).

So I am now thinking of convincing her that it is not a big deal. I will tell her that I could write a contract which says she could terminate my employment for any reason and anytime. Any suggestions?

Please provide a template for such a contract so she'll feel comfortable quickly with writing me the required employment letter?

My guess is full time employement is sufficient. You can attach offer letter which indicates the conditions of employement. If the offer letter doen't have any statements indicating its a temporary employment- it means a full time employment.

Sorry for saying this but I am wondering how you treated things so lightly knowing fully that after Sep 11th, INS is asking for each and every document before approving I-485 and that includes paystubs too. It's rather strange that you get paychecks without paystub. It's illegal. Even then, you could have taken copies of your checks all the time when u r not receiving paystubs. That would have helped you a lot. The option you have is to ask your employer to provide you a copy of all checks issued and also request tax returns in a sealed envelope (show the INS letter to them). If the employer is really interested in helping you, he will do so but without his consent, IRS will not provide you any info. I have a first hand knowledge about this tax returns of the company. Though the INS letter states that you need to bring the returns, they only ask for employer letter.

I received the INS list of required documents to present at the interview. One of the documents is employer’s tax for the last 3 years.

Some say (as you notice from above) that INS usually cares ONLY about the employment letter and pay stubs/checks.

Anybody else noticed this?

Regarding a photocopy of each paycheck, is still required to bring pay stubs at the I-485 interview? Thankfully, the person above, gcard2002, seems to suggest that they are either not that strict or they wont ask for each required document. I have the same feeling.

Technically 485 AOS is for future employment and i dont understand why BCIS needs Pay Stubs when a employment letter is sufficient>
 
I-485 Interview a couple of days away

My details are mentioned above. But one of you mentioned: "Well BCIS expects you to be legally employed..proper employer-employee relationship.."

Well, I am legally employed now. But my lawyer says this is not enough because I entered the country on an F1 visa 10 years ago but never attended college. Do you think being an illegal status for 2 or 3 months may pose any problems at interview? Remeber I got H1 visa in 1993 and re-entered the US. So does it matter?.
 
No, It shouldn't be any problem as you have already changed your status (from F1 to H1) and if there was some wrong doing, they have caught you a long time ago. So don't worry about it.
However, it might be wise fro you to egt a 2nd oppinio. from another attorney. good luck.

Yes, Changed from F1 to H1

Could one pay under 245, the fee $1000 penalty for being out of status at interview? It is called form I-485 Supplement A. The law was in effect in the the 1990's were a fee could be paid for becoming legal. I was 3 or 4 months out of status.
