any info,Will be great regarding my H status

I filled my I-140/485 last year Sep. I got my AP & EAD.I have a valid H1 stamping in my passport upto Oct'06 additionally I have 14 months unused H validity.



Now I got a query in I-140 which may take more time for my company to answer. Meanwhile I have traveled on AP and an I-94 is issued on AP at the time of re-entry. Does this mean that my H VISA is cancelled, since I have used AP?

Also, if in case we can not answer the 1-140 query, will I still have the
H1 status and work on the VISA? Will I get approval for my H extension for the above mentioned unused 14 month duration of the H Visa?

Does anyone have similar experience and an advice to share ? I would greatly appreciate your responces and guidance in this regard.
 
Using AP will not cancel your H1. As long as you continue to work for sponsoring H1 employer. You can extend your H1 in Oct'06 even if you have some problem with your 140.

I have personally went thru the situation, came back to USA in AP and had my 140 revoked for educational reasons. Even though I was on my 8th year extension based on the pending GC. We were able to file an appeal on 140 and got the H1 extension for the 9th year based on the pending appeal.

So relax you don't have any problem to be anxious

But, I have few more questions, is it possible I can call & talk to you.

Fore most thing that I am concerned very much is, since I have used AP and was issued I-94 based on AP, if now I apply for H1 extension and submit the I-94 (AOS written on it) will there be any issue?
