Any Hope?

My wife has a ban for 3 years for overstaying her visa. Our plan was to marry here in the states. She went home because her mother attempted suicide. We have been denied, just about every turn. I married her in poland last year. I can visit her every 6 months. We have about one year left to go. Is there any hope for us? We filed a waiver of excludabilty and are still waiting for an answer. That was almost a year ago. I contacted my congresswoman to see if she can help. I just feel like we are being punished. It is such a terrible feeling being without the one you love. Now i am being told that even after the ban is lifted, she still can be denied entry. We do not have a criminal record. I just do not understand. Any advice.
thank you

it would help if you are a citizen. keep all your records of the flights to show that you are still together and want to stay that way. next year put in the application.

She is being punished. She overstayed an I-94, despite the clear penalties for doing so. We have a saying in America, "if you can't do the time, don't do the crime."
