Hi everyone !

im writting this about friend of mine who had his US citizenship last week ! at the interview the officer start to ask him about his wife and iformation about the marriage too ! after that she did naturalization test which he passed !! at the end of the interview she told him that he have to file I-751 to remove his condition on the card because of USCIS error they issue him 10 years green card ! instead of 2 years one !!! so he have no idea what to do ! lawyers gives different answers ! so i thought to post here if anyone had the same experience or have info about it !!!

It is difficult to understand what you wrote, you may want to rephrase it so people here could help you.

What happened at the end? Did she recommend for approval or asked to submit some paperwork?
 
I don't know much about it, sorry, but did your friend apply for citizenship via 3 years marriage rule or 5 year resident rule?
Dang, $505.00 to file a I-751...

She asked him to file I-751 to remove the condition ! and after he get the I-751 approved he will get letter for the oath ceremony !

So what he can do now ? he have to file I-751 or is there anything ealse easier he can do ?
 
Unless your friend applied based on Section 319b (expedited citizenship for spouses of certain US citizens working abroad) or military service, or was married for at least 2 years at the time of green card approval, or obtained the green card independently of marriage, filing the I-751 and getting it approved will be required for naturalization.

Your friend needs to file I-751 ASAP, otherwise USCIS can cancel the card he has and put him in removal proceedings. In the I-751 filing he will have to include a letter explaining that it was filed late because he got a 10-year card and didn't know that the I-751 would be necessary.
 
So, assuming no special circumstances, let me see if I understand:

1. Jill is US citizen
2. Joe is not
3. Joe marries Jill in Jan 2010
4. Joe gets conditional 2 year green card
5. Joe must file I-751 90 days before Jan 2012 or Jack loses conditional green card and can be deported.
6. AND, Joe cannot file N-400 before I-751 is granted

Seems like Joe should have known what kind of green card he was getting and the conditions surrounding it in 2010, especially if lawyers were involved.
(maybe I'm giving the lawyers too much credit ;))

Change #4 to "Joe gets a 10-year green card due to USCIS error, instead of a 2 year conditional card" and that's where the problem starts.

Apparently the lawyers first got involved after Joe ran into trouble with naturalization, otherwise they would have told him that it was wrong for him to get a 10-year card before being married for 2 years.
