Hi Friends,
My wife 485 (derivative) application got approved on 11/17/2004 whearas mine (primary) is still pending.
She is going for passport stamping on Dec 2 2004. So far we haven't got approval notice in our hand for my wife
also. Actually we went together for finger printing but while filling up finger printing form instead of writting alien
number I wrote EAC number from EAD and she filled up her form correctly. On Sept 23 our LUD change and
her message change to "Finger Printing Received" while mine still showing "Case takes 365 to 540 days".
On Nov 1 and 2nd again our LUD change but no change in message. On Nov 17th our LUD again change
and for her message change to "Approved" whearas mine is still old message "365 to 540 days".
Actually I am in process of chaging job.
Now following is my question

1) Can I go with her for passport stamping since I am primary ?
2) Since her case is approved and mine is still pending do I need to file Ac21.
3) Can I take appointment with infopass with immigration officer after her passport stamping with all my documents
and photocopy of her stamped passport saying that since derivative is approved can they verify my details and
stamp my passport also.
4) Is it possible that mine case is screwed because I wrote EAC number instead of Alien number while filling up
finger printing paper.
5) Can I send all my documents (along with finger printing paper) with my wife so that after her stamping on the same day
she can inquire about my case?
6) Is it very common that derivative case approved while primary is still waiting.

Please advise what is my best bet here and how should I handle the above situation without screwing up my wife's stamping
and get in to invoking Ac21
.

Thanks in advance

My 2 cents

Definitely you can go. I would say you should go with her and take all your documents with you. I read on this forum that one of the person had a similar situation like you. He found out at the office that his case is approved and got his passport stamped right then.

Yes, you need to file AC21, since your case is separate from your wife. It sounds like your approval may happen very soon. And if the dates fall such that you change your job right after the approval then it is kind of risky. USCIS doesn't like people changing job right after they get GC. This is a grey area and there has been a lot of discussion on this. For more info on this....search for 'job change after approval' on this forum.

I would say that the USCIS made a mistake approving your wife's case because there is absolutely no legal grouds for approving a dependent's case without an approved primary case. Please call them, find out your case status and if it is pending then start an inquiry about it.
