Any harm for US GC after applying for Canada GC

Hello, every one,

I got my GC May 2005. My fiance's H1B is going to expire on May 2008. meaning I could not help her to keep legal status before I become citizen. We decide to apply Canada GC together for her backup. I have two concerns:

1. If I apply for Canada GC, whether it will do any harm for me to become citizen when the time comes?

2. If my fiance gets Canada GC, is it hard for her to get US GC after I become US citizen?

3. I heard one bill was passed, saying it will take 4 years instead of 5 years to become us citizen, if the PR has higher education. Is it true?

Thanks.

The GC gives you "permanent residence" in the US and it is called that for a reason. It means that you requested to stay in the US permanently and were granted that status provided you prove your intentions to live in the US. Applying for permanent residency of another country means you are giving up the GC as you cannot be the permanent resident of two countries at the same time. Forget about your citizenship eligibility, the chances of your GC being in danger would be high if the authorities ever come to know about this.

No.

Im not sure if this bill is passed but can someone from the citizenship forum confirm this?

That is one of the amendments of the current immigration bill...is not a law.

But I think is not about US citizenship is about the visa lottery...and is just an amendment on the bill:
"One amendment by U.S. Senators Judd Gregg (R-NH) and Maria Cantwell (D-WA) is to reform the current green card lottery program by reallocating two-thirds of the 50,000 visas currently issued to a new advanced degree lottery system. The visas issued under the proposed advanced degree visa lottery would only be available to applicants who have a master’s or doctorate degree in science, technology, engineering, or mathematics. The Gregg-Cantwell amendment, approved by a vote of 56-42, represents a bipartisan response to address shortages in these areas."

There are many things in discussions right now but does not mean that is law...even if it comes from the USCIS they cannot put on practice until it come from the Congress and sign by the President.

Good luck,

Not only that, but you risk losing your status as permanent resident in the U.S. From "Welcome to the United States: A Guide for New Immigrants" (page 10, "Maintaining Your Permanent Residence Status"):
Don’t leave the United States for an extended period of time or move to another country to live there permanently.
You should read that publication to learn about your rights and responsibilities as a permanent resident.

I do not know about Canada's requirements for permanent residents, but if they are similar then you would be unable to maintain permanent residence in both countries simultaneously.

dude one of my elder brother's had the same problem.

today his wife is a canadian citizen....she is about to move into u.s on tn visa.my brother is a gc holder here.
this is some kind of crap man...all 3 brothers got gc within a span of 2 yrs through immigration visa...2 were allready married,so they had to go through hell.
luckily i was not married but from the past 5 yrs i havent had a chance to get married coz of lpr. :D
i am almost a citizen now...so hopefully............
my other brother went back to india a couple of years ago, smartest of all went back to india for good!

Thanks very much for all your comments/suggestions. Very helpful.

For the question I posted, I missed one point. I want to keep US GC. The reason I want to apply Canada GC is because I have a Ph.D degree, my fiancee is just a technician. Thus I will have a good chance to get Canada GC approved.

Once the Canada GC approved, my fiancee will use the Canada GC as a way to come back US, if she is out of status. I will not use Cananda GC at all.

So, when I apply US citizen, should I let INS know that I once apply Canada GC or not? Whether it will put my US citizenship into danger no matter whether INS find out?

All the best.
