Well I am one of those unlucky souls whose 140 is pending since March 2003. I contacted the congressman and the congressman office was very good in getting in touch with the USCIS. But USCIS gave a standard reply saying that they are awaiting some background check information(??) for my case and they cannot provide any timeframe within which the case might get approved. So I got nothing out of it.

You may try contacting your senator or congressman. I initially wrote a email to the congressman's office but didn't get any response from them (except for the auto response). So I called them up and went to their office tio meet one of the immigration representative. She was very nice to me and took down all the details about my case. In 3 days she called me back and informed the above.

Contacted Senator office

Hi

Today I contacted the Senator office reagarding my I-140 appliaction (RD Oct 21, 2002) and she was suggesting that since I filed I-40 and I-485 concurrently, according to the new rule my I-140 MAY be processed with I-485.

She has not sent the inquiry to USCIS yet. When I hear back from them I will update this thread.

My I-140 was supposed to be approved even before the new rule came out. I am totally confused now.

I guess I just have to wait for my chance for I-485 RD Jan 23, 2003.

Thx

INS sucks!

My lawyer told me after initating an inquiry there is no guarantee my case will be reviewed within certain period of time. INS will just put the information into the computer and it is at the immigration officer's macy to review it or not. All we can do is keep inquiry again and again. Seems to me even the senator can't do much about it either. INS really sucks!!!!

After 3 enquiries your lawyer can speak to an officer directly. Atleast during that time you might come to know if our application is not trashed.

I didn't use any format. I just wrote a letter stating that I am a legal alien and applied for 140 through my employer. I took printouts from the USCIS websites showing the processing dates and mentioned that USCIS doesn't provide required info when called for.

When you sent the information to the Congressman/Senator, they would ask you to sogn the privacy statement to dosclose your info. Sign that and u should be all set.
