any exception to h1b transfer from exempt to non-exempt

hi all,

based on what i have found out, h1b transfer from exempt to non-exempt employer is subject to annual caps. are there any exceptions to it, e.g. say if h1b was obtained using premium processing, or if it was filed and obtained before the visa cap for that year was reached.
