Didn't we wait long enough to get our final approval? When do you think you can request for expedite?

Its when you feel fed up. If you look at USCIS' criteria, its almost as if
you can do so only when one of the following happens :

1) You can clearly pin-point USCIS error/mistake

or

2) Something like you didn't get it in 6 years and because of that your
brain is coming off your head or you are developing an incurable disease
because of the delays.

I think our bets are on the former. As Udacha points out, the best way to
show errors is to say
"hey look you said it would take 365-540 days, I am already 800 days".
OR
"your response says I will be hearing between 60-90 days, and its already
120 days".

State facts (same employer, name check cleared years ago (a fax from the FBI is a must), FP cleared, 3 or 4 EADs), mistakes made by the Service (no response after the 60-day letter) and the discrepancies between your receipt date and what they state on their website (1/02 vs. 06/03).

Please be polite and use English correctly (I don't think you are going to have a problem there).

Did you e-mail FBI at the standard e-mail address or did you fax ( For Name
Check status ) ? How long was it before you got a reply from FBI
about Name Check ?
My e-mail was sent more than 2 months back and no response as yet.

My case is similar to yours except that I havent received my 2nd FP till date. My first FP was done in OCT 2002 and my RD is Sept 2002. Went to local INS office and they said that I have to wait, since I have done everything I have to at this point and Have to wait for the USCIS to Approve my case. My spouse got 2nd FP in NOV by I havent received mine even though I am the primary applicant. I have another appointment at Phily next week and will try to see if they have any input.
I sent an email to fbi about name check yesterday. NOt sure what I have to do at this point.

Any input is appreciated.

Did you try Congressman's office ?

Here's my opinion :

After a long long time, they pick up some dusty files and shake the
dust off and with a cup of coffee in one hand and a mind full of
"how to screw the woman down the street"..."how to shake off my 20000$
debt"...."what to do with my son's habit of smoking pot" and similar other
concerns, they see that the FP's are more than 1 year and 6 months old.

Its at that juncture that they issue instructions for 2nd ( or 3rd or 4th )
FP. Now while the applicant duly gets the N-th FP done with high hopes,
the dusty files in Vermont go back to the dusty pile.

That's what's happening.

As for FBI Name Check, its 2 months and 4 days for me that I sent
an e-mail, no response.

I think once an applicant is doomed, s/he's doomed. I am coming around to the fact that simply nothing can be done. Period. Congressman etc may serve to provide you periodic consolation. I think as long as nobody cares,
including USCIS, Congressman and Us ( the applicants ), nothing can be done.
Status Enquiries and what you hear back from Congressman may be utterly
junk.

My advice is...use AC-21 and change jobs; will give you some fresh lease
of life; if you are unhappy again, use AC-21 again and go on.

I am, resigned to the fate of my I-485 being responded in 2006-2007 time
frame. And I am not kidding.

I got an email from Davis Hardy yesterday in response to my email dated oct 2nd, that they completed the name check back in april 03. So please allow approx 3 minths before u hear anything from them.

Does anybody have an idea on the average time for approval after FP2 for left out 2002 cases :confused: .
 
iT DEPENDS

What I have heard is that it depends on whether they have processed your case or not. Sometimes they request 2nd FP when the first one is expired. In my case, I have 1st FP done in Dec 2002, so it has been 2 years since the 2nd FP. They said that they have done their "primilinary processing" when they requst the 2nd FP, so it depends ...
